Officer RESOLUTION NO. 64R-349 ~A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE NECESSITY FOR, AND DIRECTING THE ACQUISITION BY EMINENT DOMAIN OF REAL PROPERTY FOR STADIUM COMPLEX, SPORTS ARENA, ASSOCIATED PARKING OR OTHER PUBLIC PURPOSES. WHEREAS, public convenience and necessity require the acquisition, improvement and maintenance of a public improve- ment within the City of Anaheim, to wit: a stadium complex, sports arena, associated parking or other public purposes; and WHEREAS, the City Council does find and determine that public interest and necessity require the acquisition by the City of .Anaheim of all that certain real property herein described for the improvement and maintenance of a stadium complex, sports arena, associated parking or other public purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that public interest and necessity require the acquisition by eminent domain, or otherwise, of that certain real property in the City of Anaheim, County of Orange, State of California, more particularly described as follows: to wit: PARCELS 37 AND 38: .... ~- , L ,,, ,, , ,,, Lot 3 of Tract No. 71, in the City of Anaheim, as per map thereof recorded in book 10, page 22, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the South 667~79 feet, said 667.79 feet being measured along the West line, and the North line thereof being parallel to the South line of said Lot 3; ALSO EXCEPTING THEREFROM the following: That portion of Lot 3 of Tract No. 71 in the City of Anaheim, as per map recorded in book 10, page 22, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at a point on the North line of the South 667.79 feet of said lot North 89° 39' 00" East 272.10 feet from the intersection of said line with a line which is parallel with and easterly 781.93 feet, measured at right angles from the West line of said lot; thence South 89v 59' 00'? West 139.13 feet along said North line to a point on the Southeasterly line of the Atchison Topeka and Santa Fe Railway Company's 30.00 foot wide right of way, said Southeasterly line being a curve concave Northwesterly and having a radius of 374.26 feet, a radial to said point bears South 16° 17' 15" East; thence Northeasterly 283.43 feet -1- along said curve through a central angle of 43° 23' 25" to a point of cusp with a compound curve concave Northwesterly and having a radius of 3672.29 feet; thence Southwesterly 61.23 feet along said compound curve thorough. a central angle of 0° 57' 19"; thence South 31 16' 19" West 8.53 feet to the beginning of a tangent curve concave Southeasterly and having a radius of 344.26 feet; thence Southerly 119.12 feet along said curve through a central angle of 19° 49' 31'~ to the point of beginning. PARCEL 39: The South 667.79 feet of Lot 3 of Tract No. 71, in the City of Anaheim, as per map thereof recorded in book 10, page 22~ Miscellaneous Maps, records of said Orange County, measured along the West line thereof; EXCEPTING THEREFROM the West 1304.60 feet, said distance being measured along the South line of said lot and from the center line of the street on the West. The North and West lines of the parcel herein described being parallel respectively to the South and West lines of said Lot 3. PARCEL 40: A: Ail that certain real property situated in the - Rancho Santiago de Santa Aha, County of Orange, State of California, described as: Beginning at a point 8.50 chains South and 44.01 chains North 89-3/4° West of the'Northeast corner of Lot Five (5) of the Glassell and Chapman Tract, as shown on a map recorded in Book 5, page 408 of Miscellaneous Records of Los Angeles County, California; thence South 43.79 chains, more or less, to the Lockhart Tract; thence East 4.20 chains; thence North along the West line of what was once known as the Smith Tract, 34.80 chains; thence North 89-1/2° East 2 chains to the South- west corner of Lot Eight (8) of said Glasselland Chapman Tract; thence North 2-1/4° West 1.95 chains; thence North 10° East 3.57 chains; thence North 1/4° West 3.44 chains; thence West 6.80 chains to beginning, containing 20 acres, more or less. Except all oil, gas asphaltum and other hydro- carbon substances and water, other than Santa Ana Valley Irrigation Company's water from, on or under said land. B: Ail that certain real property situated in the Rancho Santiago de Santa Ana, County of Orange, State of California, described as' -2- Commencing at a point 31.40 chains West of the Southwest corner of the Mary C. Thomas Tract, running thence West 16.62 chains; thence North 14° East 53.65 chains to the South line of the Travis Tract; thence East 3.49 chains and thence South 52.02 chains to beginning, containing 52.3 acres. EXCEPTING THEREFROM that portion conveyed to the Orange County Flood Control District and the State of California. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that public interest and necessity require the acquisition of said land by the City of Anaheim for the improvement and maintenance of the aforesaid project~ and that the taking of the property hereinabove described is necessary therefor, and that the use to which it is to be applied is a use authorized by law and the taking of said property is necessary to such use. AND BE IT FURTHER RESOLVED that the acquisition of said property by the City of Anaheim be, and it is hereby authorized and the City Attorney be, and he is hereby directed to acquire the same by an action in eminent domain, or other- wises for the acquisition of fee title to said property, and to perform and carry out all of the necessary proceedings and steps incident to the acquisition of the title to said property.
