64-340Acctg. Off. RESOLUTION NO. 64R- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES. WHEREAS, THE SYNKOLOID COMPANY, a corporation, 3345 Medford Street, Los Angeles, California, is the owner of the hereinafter described real property situated in the City of Anaheim, County of Orange, State of California; and WHERFAS, said owner has offered to sell said pro- perty to the City of Anaheim for the sum of $340,000.00 cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acquisition of said real property for municipal purposes, and that the price which the owner thereof is willing to accept is reasonable and not out of proportion to the fair market value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of The Synkoloid Company, a corporation, to sell to the City of Anaheim all that real property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of Dreyfus and Others Land, in the City of Anaheim, as shown on a map of survey made by William Hamel and filed for record in Los Angeles County, a copy of which is filed in the office of the County Recorder of said Orange County, in Book 3, Page 1.6.3 et seq. entitled "Los Angeles County Maps'- described as follows: Beginning at the intersection of the northerly line of East Vermont Avenue (formerly Broad Street) as shown on said m~p by William Hamel and the easterly line of the 50-foot Atchison, Topeka and Santa Fe Railroad right of way, as described in deed recorded in Book 407, Page 135 of Deeds, of Los Angeles County; thence easterly. along said northerly line of Vermont Avenue, 605.00 feet; thence Northerly 659.98 feet parallel with said easterly line of the railroad right_ of way to the northerly line of the southerly 17~ acres of the 35 acres bounded by the easterly line of said railroad right of way on the west, and the center line of South Street on the north, and the center line of East Street on the east, and the northerly line of East Vermont Avenue on the south; thence Westerly along said northerly line of the southerly 17~ acres, 335.00 feet to a line parallel with and distant easterly 270.00 feet measured along East South Street from the said easterly line of the railroad right of way; thence -1- northerly along said parallel line 629.95 feet to the southerly line of said East South Street; thence westerly along said southerly line 270.00 feet to said easterly line of the railroad right of way; thence southerly along said easterly line 1289.82 feet to the point of beginning. Said land being a portion of the land shown upon a Record of Surveys filed in Book 26, Page 13 of Record of Surveys, in the office of the County Recorder of said Orar~e County. for the sum of $340,000.00 cash, lawful money of the United States, be, and the same is hereby, accepted subject to the following terms and conditions: 1. That said property shall be conveyed to the City of Anaheim free and clear of all encum- brances except all general and special taxes for the fiscal year 1964-65, including any special district levies, payment of which is included therein and collected therewith; all taxes and assessments levied or assessed subsequent to the date the escrow, hereinafter referred to, is entered into between Buyer and Seller; and all covenants, conditions, restric- tions, reservations, rights, rights of way and easements of record approved by the City Attorney. 2. That the Seller shall pay that portion of the taxes for the fiscal year 1964-65 on subject property from July 1, 1964, to date the deed to the City of Anaheim is recorded. · That all machinery and equipment located within the premises on the above described property shall be removed by the Seller prior to the close of escrow, with the exception of the crane which is included in the purchase price and shall remain in the building; and that the Seller shall leave the premises in good repair. BE IT FURTHER RESOLVED that the City Manager and the City Attorney of the City of Anaheim be, and either of them is hereby, authorized for and on behalf of the City~' of Anaheim to sign escrow instructions for the purchase of said real property and to enter into an escrow with the owner of said property at United California Bank, Anaheim Main Office, Anaheim, California. AND BE IT FURTHER RESOLVED that the City Auditor be, and he is hereby, authorized to deposit in escrow at said United California Bank $340,000.00 cash, lawful money of the United States, to be paid to the owner of said real property when a deed conveying said property to the City of Anaheim free and clear of all encumbrances, except as hereinabove set forth, can be recorded and a policy of title insurance issued by Title Insurance and Trust Company, 800 North Main, Santa Aha, California, showing said property vested in the City of Anaheim as hereinabove specified. -2- AND BE IT FURTHER RESOLVED that the Seller shall pay the usual and customary Seller's charges for furnishing a policy of title insurance necessary to show title vested im the City of Anaheim, as herein provided, and that the City of Anaheim shall pay the usual Buyer's charges in the purchase of said property.
