64-325 RESOLUTION NO. 64R-325 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1630. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from JOHN F. KRAMER, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Ail that certain land situated in the State of California, County of Orange, in the Rancho Los Coyotes, City of Ana- heim, described as follows: That portion of the Northwest quarter of Fractional Section 6, Township 4 South, Range 10 West, as said Northwest quarter is shown on a map of Tract No. 2358, recorded in Book 77, page 28 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the Easterly line of the West 480.00 feet of said Northwest quarter, North 0° 38' 36" West 29.82 feet from the Southerly line of said North- west quarter; thence North 40°02~ 21" West 310.00 feet; thence North 36© 15' 36" West 91.81 feetg thence North 9© 01' 34" West 100.95 feet; thence North 0 38' 02" West 359.89 feet; thence South 87° 14' 08" East 265.34 feet to said Easterly line; thence along said Easterly line, South 0° 38' 36" East 758.17 feet to the point of begin- ning. EXCEPT that portion thereof lying Northerly and Westerly of the following described line: Beginning at a point on the Easterly line of the West 480.00 feet of said Northwest quarter, North 0° 38' 36" West 271.51 feet from the South- erly line of said Northwest quarter; thence South 89° 26' 50" West 158.90 feet; thence South 0° 38' 36" East 48.29 feet to the Southwesterly boundary of the land described herein. AND WHEREAS, nhe City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on March 30, 1964, notice of which said public hearing was duly given as re- quired by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due in- spection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1116, Series 1963-64, granting Variance No. 1630; and WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution~ the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 5th day of May, 1964, at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, the City Council does find that: i · There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. · It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting Variance No. 1630 be, and the same is hereby disapproved, and that the petition of John F. Kramer for a zoning variance permitting a waiver of the structural height limitation to permit the construction of two-story buildings, and a waiver of the garage requirement to permit the construction of carports, on the property hereinbefore described, be, and the same is hereby denied.
