64-316Erlgro RESOLUTION NO. 641:[-316 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE AND ABANDON EASEMENTS FOR PUBLIC UTILITY PURPOSES UPON, ALONG, OVER AND THROUGH THE HEREINAFTER DESCRIBED REAL PROPERTY; FIXING A TIME AND PLACE FOR A HEARING THEREON; DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS RESOLUTION. WHEREAS, a request has been made for the abandonment of easements for public utility purposes upon, along, over and through the property hereinafter described; and WHEREAS, the City Council does elect to proceed under the provisions of the Public Service Easement Vacation Law, Title 5, Division 1, Article 5 of the Government Code, to abandon said public utility easements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare that it intends to vacate, abandon and close to public use easements for public utility purposes upon, along, over and through the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Those certain portions of those certain lots in Tract No. 5053, as shown on a map recorded in Book 183, Pages 36, 37 and 38 of Miscellaneous Maps, records of Orange County, California, more particularly described as follows, to wit: The southerly portion of lot 1; The northerly 10 feet of the southerly 18 feet of lot 2; The northerly 10 feet of the southerly 16 feet of lot 11; The northerly 5 feet of lot 15; The northerly 3.5 feet of lots 16, 17 and 18; The southerly 5 feet of lots 21 and 22; The southerly 3.5 feet of lots 23 and 24; The southerly 5 feet of lots 25 and 26; The southerly 10 feet of the northerly 31.5 feet of lot 28; The southerly 10 feet of the northerly 16.43 feet of lot 34; The northerly portion of lot 35. The northerly portion of lot 36; The southerly 10 feet of the northerly 14.5 feet of lot 37; The southerly 10 feet of the northerly 30.5 feet of lot 43; The southerly 6.5 feet of lots 45 and 46; The southerly 5 feet of lots 47 and 48; The northerly 5 feet of lots 54 and 55; The northerly 6..5 feet of lot 56; The northerly 10 feet of the southerly 14.5 feet of lots 60 and 69; The southerly portion of lots 70 and 71; The northerly 10 feet of the southerly 14.5 feet of lots 72 and 81; The northerly 6.5 feet of lot 85; The northerly 5 feet of lots 86 and 87; -1- The southerly 5 feet of lots 93 and 94; The southerly 6.5 feet of lots 95 and 96; ,~ The southerly 10 feet of the northerly 30.5 feet of lot 98; The southerly 10 feet of the northerly 14.5 feet of lot 104; ~ and the northerly portion of lot 105. and that it does elect to proceed under the provisions~ of the Public Service Easement Vacation Law, Title 5, Division 1, Article 5 of the Government Code; and~ BE IT FURTHER RESOLVED that ,reference is hereby made to a map on file in the office of the City Clerk for further particulars as to the proposed vacation, abandonment and closing to public use of said easements; and BE IT FURTHER RESOLVED that a time and place for hear- ing all persons interested in or objecting to the proposed vacation and abandonment shall be fixed not less than fifteen (15) days from the date of the passage of this resolution. That the 3rd day of June 1964, at 1:30 o'clock P.M., in the CounCil Chamber in" 't'he C'ify" "~all in the City of Anaheim is here- by fixed as the time and place for a public hearing on the matter of such vacation, abandonment and closing to public use of said easements for public utility purposes, for all persons interested in or objecting to such proposed vacation, abandonment and closing to public use to appear and show cause, if any they have, why such easements and the use thereof for the purposes herein- above mentioned should not be vacated, abandoned and closed to public use; and BE IT FURTHER RESOLVED that notices of such proposed vacation and abandonment of said easements and the use thereof for the purposes herein mentioned shall be posted conspicuously along the lines of said easements at least ten (10) days before the date set for said hearing. Such notices shall be posted not more than 300 feet apart, and at least three (3) such notices shall be posted along the line of each of said easements. Such notices shall state the passage of this Resolution of Intention and the time and place of the hearing upon the matter of such vacation and abandonment of said easements; and BE IT FURTHER RESOLVED that proof of publication of any notice required by this resolution shall be made by affidavit as provided in the Code of Civil Procedure, and proof of posting of any such notice shall be made by affidavit of the person posting the notice, setting forth the facts regarding such posting; and BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and shall cause the same to be published in the manner prescribed by law, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City of Anaheim. this ATTEST: CITY CLERK OF THE CITY OF ANAHEIM THE FOREGOING RESOLUTION is approved and signed by me · 5th _ day of .May. , 1964.
