64-204RESOLUTION NO. 64R-204 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings Noo 63-64-70 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 24th day of March , 19 64 , as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 63-64-70 PARCEL 1' That portion of Blocks F and G of the Kraemer Tract, as shown on a map recorded in Book 12, Pages 87 and 88 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at the Northeast corner of said Block G; thence North 87° West along the North line of said Block, 575.44 feet; thence South 7° East 700 feet to a point in the Southerly line of said Block G, distant 361.5 feet Westerly from the Southeast corner of said Block; thence Easterly along the Southerly line of said Blocks G and. F, 748.66 feet to the Southwest corner of the tract of land des- cribed in the deed from Nick Hugo and wife, to Thomas Dietrich, recorded in Book 270, page 224 of Deeds; thence North 7° West 449.38 feet to the Northwest corner of the tract so conveyed to Thomas Dietrich; thence North 87° West 172.65 feet to the point of beginning, and containing 9.23 acres, more or less. PARCEL 2: That portion of Blocks F and K of the Kraemer Tract, as shown on a map recorded in Book 12, pages 87 and 88 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point 994.39 feet South 73° 34' 20" West along the center line of Orangethorpe Avenue from the intersection of said Orangethorpe Avenue and Placentia Yorba Road, said point being the South- west corner of that certain parcel of land described in deed to the Anaheim Union Water Company, reoo rded March 29, 1946 in Book 1399, page 527 of Official Re- cords; thence North 2° 08' 20" East 326.50 feet along the Westerly line of said parcel to a point in the center line of said Placentia Yorba Road, said point being the Northwest corner of said parcel; thence North 87° 15' 40" West 497.05 feet along the center line of said Placentia Yorba Road to the Northwest corner of that certa%n parcel of land described in the deed to William Vogele and wife, recorded May 11, 1933 in Book 609, page 297 of Official Records; thence South 8° 23' 30" East 477.38 feet along the Westerly line of the last mentioned parcel to a point in the center line of the right of way line of the Statoe Highway known as Orangethorpe Avenue; thence North 73 34' 20" East 430.49 feet along said center line to the point of be ginning. Excepting the portion included in said. Block K. Also excepting therefrom that portion lying Easterly of the Westerly line of the land described in a deed to the Orange County Flood Control District, recorded June 30, 1960 in Book 5308, page 96 of Official Records, be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE and incorpor- ated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: . That a final tract map of subject property shall be submitted to and approved by the City Council, and recorded, in the Office of the Orange County Recorder. -2- · That the completion of these reclassification proceedings is contingent upon the granting of Variance No. 1617. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
