64-202RESOLUTION NO. 64R-202 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 63-64-65 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 24th day of MArch , 19 64 , as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit' -1- 63-64-65 Lot 2 in Block 10 of the "Golden State Tract, as shown on a Map recorded in Book 4, pages 66 and 67 of Mis- cellaneous Maps, records of Orange County, California. Excepting therefrom that portion described as follows: Beginning at the intersection of the Southerly line of Anaheim Road, with the Northeasterly line of State Street, shown on said map as unnamed streets adjoining said Lot, said Southerly and Northeasterly lines being 20 feet distant from the center lines of said streets; thence along said Southerly line of Anaheim Road, North 73° 54' 12" East 45.00 feet; thence South 6° 34' 25" West 34.68 feet to the said Northeasterly line of State Street; thence along said Northeasterly line North 60° 46' 49" West 45.00 feet to the point of beginning, as described in the deed to the State of California recorded August 6, 1954 in Book 2786, page 260, Official Records of Orange County. EXCEPT the following described portion from the above described property: PARCEL 1: That portion of Lot 2 in Block 10, of the Golden State Tract, as per recorded in Book 4, pages 66 and 67 of Miscellaneous Maps in the office of the County Recorder of said County, described as follows: Beginning at the most northerly corner of that certain land conveyed to the State of California by deed recorded in Book 2786, page 260 of Official Records in said office; thence along the northerly line of said Lot, (for pur- poses of this description, said northerly line is also the southerly line of Anaheim Road as shown on said map), N. 74° 00' 46" E., 4.11 feet; thence S. 61° 52' 32" E., 289.00 feet; thence S. 61° 48' 55" E., 380.16 feet; thence S. 65° 00'17" E., 190.46 feet to a curve concave Norther- ly having a radius of 597.00 feet; thence along said curve, Easterly from a tangent which bears S. 68° 40' 29" E., through an angle of 8° 45' 17" an arc distance of 91.22 feet to the southerly line of said Lot 2; thence along said southerly line, S. 73° 59' 17" W. 116.05 feet to the southwesterly line of said Lot 2, ~said southwesterly line being the northeasterly line of an unnamed street as shown on said map); thence along said southwesterly line, N. 60° 40' 10" W., 855.92 feet to the most southerly cor- ner of said certain land conveyed to the State of Califor- nia; thence along the easterly line of said certain land so conveyed, N. 06° 40' 59" E., 34.68 feet to the point of beginning. PARCEL 2: That portion of said Lot 2 described as follows: Beginning at the easterly terminus of that certain course in the northerly line of Parcel 1 hereinabove described having a bearing of N. 74° 00' 46" E., and a distance of 4.11 feet; thence along the northeasterly line of said Parcel 1, S. 61° 52' 32" E., 101.26 feet; thence N. 28° 07' 28" E., 46.15 feet to a tangent curve concave South- easterly having a radius of 90.00 feet; thence along said -2- last mentioned curve Northeasterly, through an angle of 45° 53' 18" an arc distance of 72.08 feet to a line parallel with and distant Southerly 30.00 feet, measured at right angles from the center line of said Anaheim Road; thence along said parallel line N. 74° 00' 46" E., 36.85 feet; thence N. 15° 59' 14" W.,10.00 feet to said northerly line of Lot 2; thence along said northerly line S. 74° 00' 46" W., 206.30 feet to the point of beginning. PARCEL 3: That portion of said Lot 2 described as follows: Beginning at the southeasterly terminus of that certain course, in the northeasterly line of Parcel 1 hereinabove described having a bearing of S. 61° 48' 55" E., and a distance of 380.16 feet; thence N. 31 ° 08' 18" E., 77.73 feet; thence N. 44° 04' 19" E., 259.64 feet; thence N. 45° 05' 18" E., 147.74 feet to the easterly line of said Lot 2; thence along said easterly line, S. 16° 00' 02" E., 428.30 feet to the most easterly corner of said Lot 2; thence along said southerly line of Lot 2, N. 73° 59' 17" W., 191.10 feet to said northeasterly line; thence along said northeasterly line to the point of beginning. PARCEL 4: That portion of said Lot 2 described as follows: Beginning at a point in said northerly line of Lot 2, distant along said northerly line, N. 74° 00' 46" E., 657.22 feet from the point of beginning of Parcel 1 here- inabove described; thence S. 15° 59' 14" E., 10.00 feet to a line parallel with and distant Southerly 30.00 feet, measured at right angles, from said center line of Anaheim Road; thence along said last mentioned parallel line, N. 74° 00' 46" E., 50.00 feet to a tangent curve concave Northwesterly having a radius of 280.00 feet; thence along said last mentioned curve, Northeasterly, through an angle of 15° 21' 32" an arc distance of 75.06 feet to said northerly line; thence along said northerly line, S. 74© 00' 46" W., 124.16 feet to the point of beginning. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE,upon the following conditions: That the grade alignment of Miraloma Avenue and the Sunkist Street overcrossing shall be approved by the State Division of Highways. · That the owners of subject property shall deed to the City of Anaheim a strip of land 34 feet in width, from the center line of the street, along Miraloma Avenue, for street widening purposes. · That the owners of subject property shall deed to the City of Anaheim a street 60 feet in width, terminating in a 50-foot radius cul-de-sac, as shown on Exhibit No. 1, Revision No. 2, on file with the City of Anaheim. That said street shall have a 40-foot roadway with 10-foot parkways. -3- 4~ (a) That all engineering requirements of the City of Anaheim along Miraloma Avenue and said new street shown on Exhibit No. 1, Revision No. 2, in- cluding preparation of improvement plans and instal- lation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engi- neer and in accordance with standard plans and specifications on file in the Office of the City Engineer (curbs shall be located at 24 feet from the centerline along Miraloma Avenue, with parking prohibited); and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. · That the owners of subject prope, rty shall pay to the City of Anaheim the sum of $2.00 per front foot, along Miraloma Avenue and said new street, for street lighting purposes. · That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Miraloma Avenue and said new street, for tree plant- ing purposes. · That the existing easements for water, sewer and power facilities shall be maintained in accordance with the requirements of the City Engineer. 8~ That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked "Exhibit No. 1, Revision No. 2," and "Exhibits Nos. 2, 3 and 4, Revision No. 1." · That a six-foot masonry wall shall be constructed along the southwest and southeast property lines separating the proposed development from any abutting arterial streets or highways. 10. That the completion of these reclassification pro- ceedings is contingent upon the granting of Conditional Use Permit No. 519. 11. That Conditions Nos. 2, 3, 4(b), 5 and 6 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
