RESOLUTION NO. 64R- 114
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT BETWEEN THE CITY OF ANAHEIM AND
MRS. JESSIE L. GOODMAN WITH REFERENCE TO
SERVING WATER TO LOT 13 OF TRACT 796.
WHEREAS, the City of Anaheim desires to lower the grade
of Webster Avenue between Orange Avenue and Ball Road so that
adequate drainage can be provided for this area; and
WHEREAS, said grade lowering will necessitate reloca-
tion of a water line supplying water to Mrs. Jessie L. Goodman
at 716 Webster Avenue, Anaheim. Said property at 716 Webster
Avenue is more particularly described as Lot 13 of Tract 796
and is owned by Mrs. Jessie L. Goodman; and
WHEREAS, said Tract 796 is located adjacent to Tract
787; and
WHEREAS, Mrs. Jessie L. Goodman, owner of Lot 13 of
Tract 796, desires to have a supply of water which is adequate
to provide for fire protection and future development of her
property; and
WHEREAS, it is the desire of the City to have the water
line which runs under Webster Avenue from Lot 11 of Tract 796
to Lot 13 of Tract 796 removed; and
WHEREAS, the City of Anaheim and the owner of Lot 13 of
Tract 796 desire to enter into an agreement for the furnishing
of water by the City to said Lot 13.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement be made and entered into
by and between the City of Anaheim and Mrs. Jessie L. Goodman,
owner of Lot 13 of Tract 796, providing for the furnishing of
water by the City to said Lot 13, upon the following terms and
conditions'
1. The City shall install a 3/4-inch by 5/8-inch
meter for Lot 13 of Tract 796 at a location
adaptable to present service lines.
2. The City shall install an 8-inch water line
in Webster Avenue.
3. Mrs. Jessie L. Goodman shall waive any claim
of right to use Webster Avenue for pipeline
purposes by way of easement or otherwise.
4. In the event that Mrs. Jessie L. Goodman
increases her use of water by installing larger
or additional meters or running water to addi-
tional units through the meter installed pursuant
to said agreement, she shall pay to the City
the sum of $2.75 per front foot to reimburse
the City for the cost of installing the 8-inch
water line.

BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
