64-100RESOLUTION NO. 64R-100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 523. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from Broadway-Hale Stores, Inc., 600 South Spring Street, Los Angeles, California, to construct and operate an automobile service station on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of Lot 8 of the Anaheim Homestead Tract as per map recorded in Book 26, Page 10 of Miscellaneous Re- cords, in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at a point in the west line of the South- east Quarter of the Southwest Quarter of Section 9, Township 4 South, Range 10 West, S.B.B. & M., a portion of said west line being the west line of said Lot 8, distant along said west line, North 0° 16' 55" West 528.94 feet from the centerline of Manchester Avenue 80.00 feet wide, described in a deed to the State of California, recorded in Book 743, Page 18 of Official Records, in the office of the County Recorder of Orange County thence North 89° 43' 05" East 30.00 feet and North 84° 08~ 35" East 25.09 feet to the easterly terminus of that certain parcel described in the deed to said State, recorded in Book 2734, Page 592 of Official Records of Orange County, said point being the True Point of Begin- ning thence i . North 85° 12' 45" East 64.90 feet along the Southerly line of that certain parcel of land described as Parcel 5 in a deed to said State, recorded in Book 3253, Page 442 of Official Records of Orange County to the beginning of a non-tangent curve concave southwesterly and having a radius of 232.00 feet a radial line through said point bears North 15° 54' 35" East thence . Southeasterly along said curve through a central angle of 26° 19' 42" an arc length of 106.61 feet to a tangent line bearing South 47° 45' 43" East thence · South 47° 45' 43" East 115.12 feet to a point on the south line of said Lot 8 of the Anaheim Homestead Tract thence · South 89° 25' 20" West 159.05 feet along said south line to the easterly terminus of Parcel 6 in a deed to said State, recorded in Book 3253, Page 442 of Official Records of Orange County, '~hence . North 73° 46' 16" West 43.39 feet along the Northeasterly line of said parcel 6 to an angle point, thence -1- 6. North 33° 20' 15~ West 75.15 feet along said northeasterly line of Parcel 6 to an angle point · North 0° 16' 55" West 50.00 feet along said northeasterly line of Parcel 6 to the True Point of Beginning. Said land is shown on a map filed in Book 35, Page 16 of Records of Surveys, in the office of the County Recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at th.e City Hall in the City of Anaheim upon said application on January 6, 1964, notices of which said public hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1022 Series 1963-64, grant- ing Conditional Use Permit No. 523, subject to certain conditions therein set forth; and WHEqlEAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning CommisSion in granting said Conditional Use Permit and did thereupon fix the llth day of February, 1964, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: · The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. · The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. . The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. · The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. -2- ~ The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. , NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that~the action of the City Planning Com- mission granting said Conditional Use Permit be, and the same is hereby sustained, and that Conditional Use Permit No. 523 be, and the same is hereby, granted permitting the construction and operation of an automobile service station on the property hereinbefore described, subject to the follow- ing conditions: · That trash storage areas shall be provided in accordance with approved plans on file in the Of- fice of the Director of Public Works and Superin- tendent of Streets, prior to final building inspection. · That sidewalks shall be installed along Wilshire Avenue as required by the City Engineer and in ac- cordance with standard plans and specifications on file in the Office of the City Engineer, prior to final building inspection. · That adequate pedestrian protection shall be provided at the existing drainage facilities, which shall meet the approval of the State Division of Highways and the City Engineer. · That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibits Nos. 1, 2 and 3"; and, further, that subject property shall be developed substantially in accordance with adopted City of Anaheim Service Station Minimum Site Develop- ment Standards. · That this Conditional Use Permit is granted subject to the completion of Reclassification Proceedings No. 63-64-67 now pending. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
