64-053RESOLUTION NO. 64R-5 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE C~NGED. WHEREAS, the C. ity Pla. nning Commission of the City of Anaheim did hold a p. ublzc hearzng in Reclassification Pro- ceedings No~ 63-6~-64 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the Cit. y Council did fix the 28th day of January , 19 64 ' as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof im the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW THEREFORE, BE IT RESOLVED by the City Council of the City o~ Anaheim that Title 18 of the Anaheim'Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit' -1- 63-64-64 That portion of the southwest quarter of the southwest quarter of Section 17, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, California, as shown on a map recorded in book 51, page 10 of Miscellaneous Maps, records of Orange County, described as follows: Beginning at a point on the west line of said Section 17, and on the center line of Brookhurst Street, said point being distant North 0° 40' 06': East 913.17 feet along said west line from the southwest corner of said Section 17; thence from said point of beginning easterly at right angles 280.00 feet; thence southerly at right angles 232.00 feet;thence westerly at right angles 280.00 feet; thence northerly at right angles 232.00 feet along said west line of said Section 17 to the point of beginning. EXCEPTING THEREFROM the westerly 60.00 feet and the northerly 32.00 feet thereof as being reserved for public street purposes. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in C-l, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions' 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 54 feet in width along the north side of subject property for street purposes, said proposed street to be known as Brookmore Avenue. (This will provide a 12-foot parkway on the south, a 40-foot roadway, and a 2-foot parkway on the north.) 2. (a) That all engineering requirements of the City of Anaheim along Brookhurst Street and Brookmore Avenue, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of' $2.00 per front foot, along Brookhurst Street and Brookmore Avenue, for street lighting purposes. 4. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No. 1, as amended herein; PROVIDED, HOWEVER, -2- that a 10-foot setback shall be maintained along Brookhurst Street, and that the sign indicated~ shall not be considered a part of this exhibit~~ 5. That a 10-foot strip of land, where adjacent to buildings, and a 3-foot strip of land,~ where adjacent to parking areas~ shall be landscaped and said landscaping maintained on the 'Brdokhurst Street and Brookmore Avenue frontages as indicated on Exhibit No. 1 on file with the City; that plans for' said landscaping~-Jshall be sub- mitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 6. That the completion of these reclassification p~oceedings is contingent upon the granting of Variance' No. 1614. , That Conditions Nos. 1, 2(b) and 3 above-mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
