63-1024 RESOLUTION NO. 63R-1024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 492 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from HELENA J. TRAPP and BANK OF AMERICA NATIONAL TRUST & SAVINGS ASSOCIATION, 801 N. Main Street, Santa Ana, California, permitting a waiver of the one-story height limitation and a waiver of the garage requirement to allow the construction of a one and two-story, multiple-family planned residential development, with carports, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the East half of the Northeast Quarter of the Southeast Quarter of Section 12, Township 4~. South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the center line intersection of Lincoln Avenue (formerly Anaheim-Olive Road) and Rio Vista Street, the center line of said Rio Vista Street also being the easterly line of the Southeast Quarter of said Section 12; thence North 10 03' 49" East, along the center line of Rio Vista Street, a distance of 478.70 feet to the true point of beginning; thence North 890 14' 48" West parallel with the North line of the Northeast Quarter of the Southeast Quarter of said Section 12, a distance of 427.00 feet; thence South 280 57' 57" West a distance of 263.44 feet to an angle point on the Northeasterly right-of-way line of State of California freeway right-of-way; thence North 460 25' 39" West, along said Northeasterly right- of-way line, a distance of 151.35 feet to the West line of the East half of the Northeast Quarter of the Southeast Quarter of Section 12; thence North 10 05' 36" East, along said West line, a distance of 713.27 feet to the Northwest corner of said east half; thence South 890 14' 48" East, along the north line of said East half a distance of 661.48 feet to the northeast corner of said East half and the center line of Rio Vista Street; thence South 10 03' 49" West, along said center line of Rio Vista Street, a distance of 584.00 feet to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on October 28 , 19 63 , notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies ~de by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 952 Series 1963-64 denying Conditional Use Permit No. 492 ; and -1- ~lr .. ":-"~':"""""'f"",:,~,.t"'$!~",*",",,,*,.n.",,:-,,', ;,~;"'~"_'''~"iiIiI~~;;~"*"",~","",,",,,, WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Condi- tional Use Permit and did thereupon fix the 26th day of November , 19 63 ,as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor~ tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. / 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW~ THEREFORE~ BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying said Conditional Use Permit be, and the same is hereby disapproved , and that Conditional Use Permit No. 492 be, and the same is hereby, granted permitting a waiver of the one-story height limitation and a waiver of the garage requirement to allow the con- struction of a one and two-story, multiple-family planned residential development, with carports, on the property hereinbefore described, subject to the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of ~2S.00 per dwelling unit, to be used for park and recrea- tion purposes, said amount to be paid at the time the building permit is issued. -2- .-,r-"~ "-,~--~ ,--- ,~-, - '''".,....:...",."~.;4.~~"''"'''''.,,. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works, prior to final building inspection (not necessarily in accordance with plans of development as submitted). That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, prior to final building inspection. 3. 4. That subject property shall be developed sub- stantially in accordance with plans and specifica- tions on file with the City of Anaheim, marked "Exhibit No. l, Revision No. l," and "Exhibit No.2." 5. That 6-foot masonry walls shall be constructed (1) between subject property and the ad~oining property to the south (described as Portion 'A" in Resolution No. 63R-I023 in Reclassification Proceedings No. 63-64-48); (2) where said properties abut the future freeway right of way; and (3) along the southerly 125 feet of the westerly boundary of subject property, said walls to be constructed prior to final building inspection. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of 6-foot masonry walls along the westerly and northerly boundaries of subject property in the event the abutting properties to the west and north are developed for single-family residential purposes; and, in the interim, 6-foot cyclone fences shall be installed along the northerly boundary of "C" Street and along the westerly boundary of "B" Street, said streets being indicated on Exhibit No.1, Revision No. 1 on file with the City. That tree wells shall be provided at approximately 40-foot intervals in the Rio Vista Street and Lincoln Avenue parkways abutting subject property and the adjoining property to the south, and at approximately 40-foot intervals in the Rarkways abuttin~ said properties on Streets "A, , liB" and "c, indicated on Exhibit No.1, Revision No. 1; that plans for said tree wells and the p1antings therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted with trees prior to final building inspection. That subject property and the adjoining property to the south shall be landscaped as indicated on Exhibit No.1, Revision No.1, on file with the City of Anaheim; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 6. 7 . 8. -3- ,."....-....,,;...,.... ,i,,;,"*',""'.I"~.__4...,..,..,......,..j......._'*.;....i_.~~ ~. 9. That all air conditioning facilities on the property adjoining subject propertx on the South, and described as Portion "A' in Resolution No. 63R-1023, shall be properly shielded from view from abutting streets. 10. That adequate alley cut-offs shall be provided for trash collection where necessary. 11. That adequate turn around area shall be provided at the end of the southerly alley on Parcel No.2, said Parcel No. 2 being shown on Exhibit No.1, Revision No.1. l2. That the owners of subject property and the adjoining property to the south shall pay to the City of Anaheim the sum of 15~ per front foot along Rio Vista Street, Lincoln Avenue and the newly dedicated streets, for street trees. 13. That this Conditional Use Permit is granted subject to the completion of Reclassification Proceedings No. 63-64-48 now pending. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
