JLEVARD INTERCHANGE E NItANCEIdEN I WHEREAS, the Anaheim Redevelopmenl Agency (the "Agency") is a community :'edevelopment agency organized and existing ~nder the Commtmity Redevelopment Law, II'ealth and Safety Code Section 33000 el. seq., and WHEREAS, the (lily Council of the City of Anaheim (the "City Council") adopted tl~¢ Redevelopment Plan tbr the Alpha Redevelopment Project ("Pr0iect Alpha") on July 1 o, 1973, by Ordinance No. 3190, and as said plan was firsl amended by lhe City Council on July 20, 1976, by Ordinance No. 3631, and as said plan wns third amended by the City Council on Jam~ary 5, 19I~2, by Ordinance No 4300; and WHEREAS, the A~aheim Redevelopment Agency is engaged in activities necessary nnd approlniatc, to ca[fy ot~t such redevelopment plan for Project Alpha; and WIfEREA S, Section 33445 of the Cali fornia Community Redevelopment Law (tlealth and Safety Code Section 33000, et serl.) authorizes a redevelopment agency, with tile consent of the legislative body, to pay all or part of the value of the land for and the cost of the installation an(I const~t~ction of any building, facility, structure, or other i~provement which is pul>licly owned elfin, er x~,ithin or will~out tile project area upou certain findings; and WI-IFA(IiAS, tim Stale of California ha:; enacted the Transportation lthmpfint I..cgislation of 1989, (;\B,17 !) wl~ich is to make available $100 million in state environmental dollars over a ten year period a:; funds to the California Transportation (:omufission fo~ enhancenmnt activities; and WHEREAS, the (;alitbrnia Resources Agency has established rite procedures and c~ iteria for reviewing prolmsals and will submit to the California Transportation Come,fission a list of rccomn~ended projects fr~)m wi'rich the recipienfs will be selected; anti WItF. I)()C WHEREAS, the al~pllcatlon contains assurances that the applicant must comply with; and WHEREAS, the applicant, if selected, will enter into an agreement wit the State of California to carry out the transportation enhaacement activities project; and WHEREAS, the Agency desires to apl,ly for funding to physically enhance the 91 Freeway/Kraemer Boulevard Interchange (the "Interchange Enhancement Project"); and WIIEREAS, the Agency proposes to commit approximately Fifty Four Thousand Dollars ($54,000) of its ta~ increment funds to pay for approximately ten percent of the costs of the Interchange Enhancement Project if the grant is received; and V~qtEREAS, the expenditure of Agency fi~nds for the Interchange Enhancement Project is ofbenefit to PrQect Alpha and the surrounding development, and is necessary to effectuate the purposes of the Project Alph:~ redevelopment plan, because the Interchange Enhancement project will provide an aesthetically enhanced entrance into the Anaheim Canyon Business Center in the Nortlmast Industrial portion of Project Alpha, one of the major gateways, into the Project Area; and WHEREAS, the California Departmer,t of Transportation, and not tile Agency, would be responsible for tile maintenance and operation of the Interchange Enhancement Project; and WHEREAS, there are no other reasonable means of financing the cost of the Interchange Enhancement Project as the City t~as no funds in its general fund or capital improvement accounts which are currently un.~ncumbered or available for the benefit and ~se of'the Agency, and likewise, the Agency l'~as no alternative sources of fi.mding to pay for the costs of the Intercimnge Enhancement Project. NOW TtlEREFORE, TIlE ANAHEIM REI)EVELOPMENT AGENCY DOES RESOLVE AS FOLLOWS: Section 1. The Agency finds and ~letcrmines that Agency's pay~nent of a portion of the costs of the Interchange Enlmn,;ement Project is of benefit to Project Alpha and the surrounding development, and is necessary to effectuate tile purposes of the Project Alpha redevelopment plan. Section 2. The Agency finds and ~letermines that no other means of financing the Agency's payment of a portion of tile costs of the Interchange Enhance~nent Project are available to the comm~.~nity. · Section 3. The Agency is authori:.ed to pay for the Agency's share of the costs of the Interchange Enhancement Project, upon receipt of state fi~nds for such project. F:\D()CS~.I') EVS VCg'~RF. The Agency hereby approves the filing of an application for the Environmental Enhancements and Mitigation Program for consideration for fi~nding the Interchange Enhancement Project, and directs; the Executive Director of the Agency, or her designee, to file such al~plication. · Section 5. The Executive Director of the Agency is hereby authorized, on behalf of the Agency, to conduct all negotiations and to execute and suNnit ali documents, including but not limited to applications, agreements, amendments, and payment requests, which may be necessary or appropriate for th,,' completion and funding of the Interchange Enhancement Project.
