Sohl EXECUTIVE DIRECTOR OF COMMUNITY DEVELOPMENT: Lisa Stipkovich A complete copy of the agenda for the meeting of the Housing Authority was posted at 3=20 p.m. on November 22, 1995 at the Civic Center kiosk, containing all items as shown herein. Chairman Daly called the regular meeting of the Anaheim Housing Authority to order at 6:05 p.m. FINANCIAL DEMANDS AGAINST THE ANAHEIM HOUSING AUTHORITY in the amount of $16,300.89 for the period ending November 20, 1995 and $2,025.44 for the period ending November 27, 1995, in accordance with the 1995-96 Budget, were approved. ADDITIONS TO THE AGENDA: There were no additions to agenda items. ITEMS OF PUBLIC INTEREST: No items of public interest were addressed. PUBLIC COMMENTS - AGENDA ITEMS: There were no public comments on Housing Authority Agenda items. . 121. HEARINGS - SOUTH OF ROMNEYA REVITALIZATION PLAN - RESOLUTIONS OF NECESSITY - 724 W. JULIANNA~ See Staff Report dated November 28, 1995 from the Community Development Department recommending adoption of the resolutions of necessity for the subject properties. Chairman Daly. This is the time for the due process hearing on proposed acquisition by eminent domain relating to the subject properties. Lisa Stipkovich, Executive Director of Community Development. Staff has been working on the South of Romneya Revitalization Plan for some time which requires that they acquire property in the area. The hearings are about the need the Authority has to acquire the property and not the value of the property. This is due process and necessity to acquire the property in order to complete the project. City Attorney White. These are separate hearings to be acted upon by the Authority even though they relate to one overall project. Chairman Daly. He opened the hearing(s) on the subject properties and asked if the property owner or a representative of the properties was present and wished to speak. Only property owners or their representatives may present testimony. Mr. Manuel Reynoso, property owner, 729 W. Julianna, Anaheim. He asked the time frame that he had to make the "deals" and for remodeling or moving the people he has in the apartments. 95-1 NOV~HD~R 28~ L~5~ 5;00 Lisa Stipkovich. It is necessary for this action to go forward tonight but as far as negotiating and continuing to talk about values, which she knows is the major issue between the Housing Authority and Mr. Reynoso, they would have at least 90 days. The tenants do not have to move. The Authority will make sure they either continue in occupancy or, if overcrowded, they are moved to adequate quarters. She reiterated they will have at least 90 day's notice and the Authority will take care of that. She also confirmed for Mr. Reynoso that Mr. Cunningham, a representative of the company the Authority hired to make the acquisition, is still the person he will be dealing with. Mr. Nguyen, owner of 723 & 729 W. Bywood, Anaheim. He asked if all properties were involved or just his property. Lisa Stipkovich. There are about six different properties involved in the condemnation hearing today. He (Nguyen) owns two of the properties and there are four other owners involved in different actions tonight. There was a previous hearing involving four owners. Mr. Nguyen. He expressed his concern relative to the value of his property and that the offer by the Authority was too low. If the City wants to condemn his property for the public interest, he is willing to do that but he feels the City has been unfair. Tomorrow he has to show up in court on his building. He possibly faces jail time while at the same time the City is making an offer on his building. City Attorney White. He explained the purpose of the hearing(s) tonight and the only issues that are germane at this time. The issue of value is certainly one that the Authority is sensitive to and there is an opportunity to continue to discuss that issue with the property owner but it is not the reason for tonight's hearing. There is time to discuss that even after the hearing tonight. Mr. Nguyen. He is concerned that City employees asked him to sign a document but he had to review it with his attorney. He reiterated, there is a law suit pending and the City is trying to put him in jail. Chairman Daly. He closed the hearing(s) since there were no further persons who wished to speak on any of the subject properties. Lisa Stipkovich. She then explained for Authority Member Tait what the process is if there is a dispute with the property owner regarding value of the property. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: On motion by Chairman Daly, seconded by Authority Member Feldhaus, the Authority finds a negative declaration has previously been approved and that there are no additional impacts in connection with the subject action. MOTION CARRIED. Chairman Daly offered Resolution No. AHA95-9 through AHA95-13, both inclusive, for adoption. RESOLUTION NO.
