RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY APPROVING
AND AUTHORIZING THE EXECUTION OF AN OWNER PARTICIPATION
AGREEMENT WITH THE CALIFORNIA STATE TEACHERS RETIREMENT
SYSTEM AND MAKING CERTAIN FINDINGS IN CONNECTION
HEREWITH.
WHEREAS, the Anaheim Redevelopment Agency (the "Agency") is
carrying out the Redevelopment Plan (the "Redevelopment Plan") for
the Plaza Redevelopment Project, (the "Project Area"); and
WHEREAS, the Agency has received from the California State
Teachers Retirement System (the "Participant") a proposed Owner
Participation Agreement (the "OPA"), providing for the development
of a promotional/retail pedestrian shopping center on certain real
property (the "Site") located within the boundaries of the Project;
and
WHEREAS, pursuant to the OPA, the Agency will be responsible
for a portion of the costs of certain public improvements to be
constructed and installed in connection with the development of the
Site; and
WHEREAS, pursuant to Section 33445 of the Community
Redevelopment Law, the Agency is authorized with the consent of the
City Council to be responsible for all or any part of the value of
and the cost of installation and construction of any building,
facility, structure or other improvement which is publicly owned
either within or without the Project Area upon a determination by
the City Council that such building, facility, structure or other
improvement is of benefit to the Project Area or the immediate area
in which the Project is located and that no other reasonable means
of financing such building, facility, structure or other
improvement is available to the community; and
WHEREAS, Final Supplemental Environmental Impact Report,
analyzing new and/or additional impacts which may be caused by the
Participant's development of the Site, was prepared and certified
by the Agency to supplement the Program EIR previously prepared and
certified for the Project Area, and environmental findings and a
mitigation monitoring program were adopted by the Agency; and
WHEREAS, the Agency has been presented with Basic Concept
Drawings and Schematic Drawings pursuant to preliminary plan review
criteria contained in the OPA, (collectively the "Site Drawings")
with respect to the Participant's proposed development of the Site.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelopment
Agency as follows:
Section 1. The Agency hereby finds and determines that (i)
the provision of public improvements by the Agency in connection
with the development of the Site in the manner set forth in the OPA
is of benefit to the Project Area and that (ii) no other reasonable
means of financing such public improvements is available to the
community, and the Agency is authorized, based upon consent of the
City Council, to participate in the costs for all or part of the
costs of installation and construction of public improvements in
accordance with the OPA.
Section 2. The Agency hereby approves and authorizes
execution of the Owner Participation Agreement and the Executive
Director and Secretary are hereby authorized and directed to
execute said OPA on behalf of the Agency, and the Agency authorizes
the Agency's Executive Director to take such actions referenced in
the OPA to carry out the terms and conditions of the OPA.
