ARA1992-05RESOLUTION NO. ARA92-5 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY ADOPTING RESIDENTIAL DESIGN GUIDELINES FOR AFFORDABLE HOUSING DEVELOPMENT WHEREAS, pursuant to Health and Safety Code Section 33334.2, et seq., the Anaheim Redevelopment Agency (the "Agency") has established a Low- and Moderate-Income Housing Fund ("Housing Fund") to be used to increase, improve and preserve the City's supply of low and moderate income housing available at an affordable housing cost; and WHEREAS, the Agency is authorized by Health and Safety Code Section 33449 to acquire land, donate land, improve sites or construct and rehabilitate structures in order to provide housing for persons and families of low or moderate income, and very low income households; and WHEREAS, the City of Anaheim has adopted a Housing Element to the City's General Plan, the implementation of which requires the City's Community Development Department to prepare a design manual and implement residential design guidelines for "all housing projects making use of public resources, either directly through public funding and/or indirectly through such programs as density bonuses"; and WHEREAS, the Agency is authorized to issue and/or participate in the issuance of bonds for the purpose of financing or assisting in the financing of construction or rehabilitation of affordable housing for persons and families of low- and moderate income; and WHEREAS, the Anaheim Community Development Department has prepared a design manual entitled "Residential Design Guidelines", a copy of which is attached hereto and incorporated herein by reference; and WHEREAS, the Residential Design Guidelines establish a six-phase process for pre-application conferences, conceptual and final design review, design plan check and construction inspection in addition to the review process otherwise required of development projects under the City Municipal Code; and WHEREAS, the Residential Design Guidelines are intended ho establish an advisory process whereby technical assistance is given to project applicants to ensure a high level of design of affordable housing projects, to ensure the liveability of new housing and to provide for the compatibility of such housing projects with neighboring areas; and WHEREAS, the Residential.Design Guidelines do not establish an additional approval process for affordable housing projects, but instead are meant to provide additional information for the City Planning Commission and City Council to consider in their review and approval of such development projects; and WHEREAS, the Planning Commission of the City of Anaheim has recommended the adoption of the Residential Design Guidelines; and WHEREAS, the Agency desires to adopt the Residential Design Guidelines as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelopment Agency as follows: SECTION 1. That the Agency hereby adopts those certain guidelines as attached hereto as the Residential Design Guidelines of the Anaheim Redevelopment Agency which shall be the applicable design guidelines for the following policies and programs: (a) Any transaction or program funded by expenditures from the Housing Fund which involves the construction or substantial rehabilitation of affordable housing for persons and families of low- and moderate-income; (b) Any transaction or program funded by expenditures from other Agency funds to acquire land, improve sites, or construct and substantially rehabilitate structures in order to provide housing for persons and families of low- or moderate-income households. (c) Any bonds which the Agency issues or participates in issuing for the purpose of financing or assisting in the financing of the construction or substantial rehabilitation of affordable housing for persons of low- and moderate-income. SECTION 2. That any affordable housing agreement by and between the Agency and a person or entity which proposes to construct housing for persons of low- or moderate-income at an affordable housing cost, when such project makes use of the Agency Housing Fund or other Agency resources, shall require that the (~eveloper of such housing comply with the Residential Design (;uidelines advisory process. SECTION 3.
