A RESOLUTION OF THE ANAHEIM REDEVELOPMENT
AGENCY AUTHORIZING THE EXECUTIVE DIRECTOR
TO ACQUIRE PROPERTY ON BEHALF OF THE AGENCY
WHEREAS, in order to acquire and assemble
sites for proposed developments it is necessary for the
Agency to obtain appraisals of the fair market value of
property, to establish just compensation for such
property, and to execute various legal instruments for
the acquisition thereof; and
WHEREAS, in order to facilitate the
day-to-day efforts of the Agency staff, it is desirable
to authorize the Executive Director to obtain
appraisals of property which may be acquired by the
Agency and to take such steps as are necessary to
acquire sites for proposed developments; and
WHEREAS, the procedure for acquisition o~
property by the Agency established under Reselution ARA
76-25 and modified by Resolution ARA 76-36 was limited
to Project Alpha; and
WHEREAS, additional project areas have been
established since the adoption of the Resolutions
mentioned hereinabove, and
WHEREAS, it is desirable to modify the
existing procedure and extend it to include all of the
Agency's project areas.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim
Redevelopment Agency as follows:
1. That Resolution No. ARA 76-36 is hereby
superseded in its entirety.
2. That the Executive Director be, and is
hereby authorized to proceed with the acquisition of
property located:
a~ Within Redevelopment Project areas for
redevelopment purposes generally.
b. Outside of Redevelopment Project areas for
the purpose of rehabilitation or development
of low and moderate income housing for
persons displaced by Redevelopment
activities.
3. That the Executive Director be, and is hereby
authorized to:
a. Retain the services of appraisers to appraise
properties to be acquired by the Agency.
b. Approve, after thorough review and
consultation with appropriate staff members,
all such appraisals on behalf of the Agency.
c. Establish just compensation to be paid in the
acquisition of property on the basis of the
aforesaid approved appraisals.
d. Accept and execute, on behalf of the Agency,
all legal documents required to initiate .and
complete the acquisition process provided,
however, that the consideration to be paid by
the Agency shall not exceed the amount of
just compensation established in the
preceding paragraph "c".
e. All property acquisition shall be conducted
in accordance with the provisions of the
California Relocation Assistance Law
(Government Code, Section 7260 et seq.), the
Agency's Rules and Regulations for
Implementation of the California Relocation
Assistance Law, and other applicable laws.
THE FOREGOING RESOLUTION is approved and signed
by me this 17th day of December, 1991.
