ARA1991-14RESOLUTION NO APAql-14 RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY AUTHORIZING EXECUTION OF AN AGREEMENT BY AND BETWEEN THE ANAHEIM REDEVELOPMENT AGENCY AND THE COUNTY SANITATION DISTRICT NO. 2 AND NO. 3 WHEREAS, the City Council of the City of Anaheim (the "City Council") adopted and approved the Redevelopment Plan (the "Redevelopment Plan") for the Plaza Redevelopment Project (the "Project") by Ordinance No. 5136 on June 12, 1990; and WHEREAS, the Redevelopment Plan includes provision for tax increment financing; and WHEREAS, based upon information presented on behalf of the County Sanitation District No. 2 of Orange County, California, and County Sanitation District No. 3 of Orange County, California (the "Districts"), it appears that the Project may cause a financial burden, or detriment to the Districts and that certain payments are necessary to alleviate such financial burden or detriment; and. WHEREAS, the Districts have approved an agreement (the "Agreement") which is attached hereto and incorporated herein by reference providing for certain payments to the Districts, which payments will alleviate any and all adverse fiscal impact on the Districts resulting from the Project; and WHEREAS, the Redevelopment Plan is the subject of a litigation matter entitled Lara, et al. v. All Persons Interested in the Matter of the Validity of the Redevelopment Plan for the Plaza Redevelopment Project, et al., O.C.S.C. Case No. 633 204, which challenges the validity of the Redevelopment Plan. NOW, THEREFORE, THE ANAHEIM REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Agency finds that the Project may cause a financial burden or detriment to the Districts and that the payments as are provided for in the Agreement are necessary to alleviate the financial burden or detriment of the Districts. Section 2. The Agreement is approved, and the Chairman or Executive Director and Agency Secretary are authorized to execute the Agreement, to take all steps necessary for the implementation of the Agreement, and to cause payments to be made to the Districts pursuant to the Agreement.
