ARA1990-18RESOLUTION NO. ARA90-18 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY AUTHORIZING THE USE OF MONIES FROM THE LOW AND MODERATE INCOME HOUSING FUND FOR THE HOMELESSNESS PREVENTION PROGRAM WHEREAS, the Anaheim Redevelopment Agency ("Agency") is a Community Redevelopment Agency organized and existing under the Community Redevelopment Law, Health and Safety Code ~33000, et seq. (the "Act"); and WHEREAS, ~33334.2 of the Act requires that not less than twenty percent (20%) of all taxes which are allocated to the Agency pursuant to ~33670 of the Act shall be used by the Agency for purposes of increasing and improving the community's supply of low and moderate income housing ("Low and Moderate Income Housing Fund"); and WHEREAS, pursuant to §33334.2 of the Act, the Legislature declares its intent that the Low and Moderate Income Housing Fund shall be used to improve and increase housing in the community: and WHEREAS, to carry out the purposes of increasing and improving the community's supply of low and moderate income housing, ~33334.2(e) of the Act states the Agency may exercise any or all of its powers including, without limitation, providing subsidies to, or for the benefit of, very low income households, lower income households, or persons or families of low and moderate income; and WHEREAS, on March 20, 1990, the City Council adopted Resolution No. 90R-80 approving the use of monies from the Low and Moderate Income Housing Fund for one-time rental assistance payments for very low income households to obtain permanent housing; and WHEREAS, the Agency now desires to use such funds to assist very low income households in securing and retaining permanent housing by providing one-time only grants to be used for paying first and last month's rent and other security deposits for rental housing, and paying such amounts as are necessary to stay the eviction of such persons from their rental housing (the "Homelessness Prevention Program"); and WHEREAS, the Homelessness Prevention Program will provide for the expenditure of Low and Moderate Income Housing Fund monies for the purposes of increasing and improving the community's supply of low and moderate income housing available at affordable housing cost to persons of very low income~ and WHEREAS, the Homelessness PrevenTion Program will provide subsidies to or for the benefit of persons and families of very low income to the extent those households cannot obtain housing at affordable costs on the open market:, and WHEREAS, the Homelessness Prevention Program funds may be used inside or outside any established Project Area of the Agency, because use of such funds outside of established project areas will be of benefit to all of the Agency Project Areas; and WHEREAS, the costs of undertaking the Homelessness Prevention Program may be paid entirely from the Low and Moderate Income Housing Fund of the Agency because the Homelessness Prevention Program activities will result in the provision or preservation of housing units which are consistent with the provisions of Section 33334.2 of the Act. NOW, THEREFORE, the Anaheim Redevelopment Agency finds, declares and resolves as follows: ' 1. The recitals above are fully incorporated into this resolution. 2. The expenditure of monies from the Low and Moderate Income Housing Fund for the Homelessness Prevention Program outside the existing Project Areas for purposes authorized under the Act are and will be of benefit to the Project Areas. 3. The expenditure of monies from the Low and Moderate Income Mousing Fund for the Homelessness Prevention Program will increase and improve the community's supply of low and moderate income housing. ~ 4. The Agency is hereby authorized to expend monies from the Low and Moderate Income Housing Fund for the Homelessness Prevention Program.
