RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY
APPROVING AND AUTHORIZING THE EXECUTION OF AN
OWNER PARTICIPATION AGREEMENT WITH COMMUNITY
SYSTEMS ASSOCIATES, INC., AND WJS INVESTMENTS,
LTD. ("PARTICIPANT") AND MAKING CERTAIN FINDINGS
IN CONNECTION THEREWITH.
WHEREAS, the Anaheim Redevelopment Agency (the "Agency") is
carrying out the Amended Redevelopment Plan (the "Redevelopment
Plan") for the River Valley Redevelopment Project, (the
"Project"); and
WHEREAS, the Agency has received a proposed Owner
Participation Agreement (the "gPA") from Participant, including
a Financing Agreement atbached thereto as Attachment No. 4,
providing for the development of a retail shopping center on
certain real property (the "Site") located within the
boundaries of the Project; and
WHEREAS, pursuant to the OPA, the Agency will be
responsible for a portion of the costs of certain public
improvements to be constructed and installed in connection with
the development of the Site; and
WHEREAS, pursuant to Section 33445 of the Community
Redevelopment Law, the Agency is authorized with the consent of
the City Council to be responsible for all or any part of the
value of and the cost of installation and construction of any
building, facility, structure or other improvement which is
publicly owned either within or without the Project Area upon a
determination by the City Council that such building, facility,
structure or other improvement is of benefit to the Project
Area or the immediate area in which the Project is located and
that no other reasonable means of financing such building,
facility, structure or other improvement is available to the
community; and
WHEREAS, Draft Subsequent EIR No. 289 considered the
following discretionary actions to be considered or which have
been considered'by the City of Anaheim, the Anaheim
Redevelopment Agency, or the Anaheim Redevelopment Commission:
General Plan Amendment No. 271, the First Amendment to the
River Valley Redevelopment Plan, Zoning Reclassification No.
89-90-22, Conditional Use Permit No. 3206, Development
Agreement No. 83-02 (as amended and restated), and Development
Agreement No. 89-02; and
WHEREAS, the Agency has been presented with Basic Concept
Drawings, including color and materials palette ("Basic Concept
Drawings") with respect to the proposed development of the Site.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelopment
Agency as follows:
Section 1. The Agency hereby finds and determines that
the provision of public improvements by the Agency in
connection with the development of the Site in the manner set
forth in the OPA is of benefit to the Project Area and that no
other reasonable means of financing such public improvements is
available to the community, and the Agency is authorized, based
upon consent of the City Council, to participate in the costs
for all or part of the land the costs of installation and
construction of such public improvements in accordance with the
OPA.
Section 2. The Agency hereby finds and determines that
Draft Subsequent EIR No. 289, which, among other things,
evaluated the proposed development described in the OPA, was
certified on January 23, 1990 by the City Council, and that a
statement of overriding considerations and a mitigation
monitoring program for the Project was adopted.
Section 3. The Agency hereby approves and authorizes
execution of the Owner Participation Agreement and the
Executive Director and Secretary are hereby authorized and
directed to execute said Owner Participation Agreement on
behalf of the Agency after the same has been formally approved
and executed by the Participant; and to cause a notice of
determination to be filed with the County Clerk.
Section 4. The Agency hereby approves the Basic Concept
Drawings, as submitted.
