PRESENT: COUNCILMEN: Dutton~ Chandler, $chutte and Coons~ ABSENT: COUNCILMAN: Krein~ PRESENT: ASSISTANT CITY MANAGER: Robert Davis. CITY ATTORNEY: Joseph Geisler° CiTY CLERK: Dene M. Williams. CITY ENGINEER: 3ames P. Maddox. The meeting was called to order by Mayor Coons. MINUTES: Minutes of the meeting held February 4~ 1964~ and adjourned regular meeting held February 5, 1964~ were approved on motion by Councilman Schutte, seconded by Councilman Dutton. MOTION CARRIED° ,C, ONVENTION FACILITY - PROPOSED AGREEMENT _ ADRIAN WILSON AND ASSOCIATES ,ARCHITECTS: Mro Davis advised that the proposed contract has been reviewed and was agreeable to all parties~ however a question was raised concern- ing one point, that Mro Dimmi± representing Adrian Wilson and Asso¢iates~ was present to discuss this point with the City Council. Mr. Richard Dimmit~representing Adrian Wilson and Associates, 816 West Fifth Street, Los Angeles, California~ advised that they were in agreement with the contract as proposed with the exception of one point noted under "Architect's Responsibility" (Page 2)~ that under the present language it would eliminate the seats from the control of the Architect. They agreed that the por'gable seats could be eliminated from their controli however felt~ that the fixed seats should not be eliminated for the following reasons: 1. In the basic design and lay-out of the arena the seats should be laid out for width and be in control wifh the aisles for maximum use of the facility. 2~ The Acoustical Engineer must have necessary information in order to submit recommendation for the seat specification %o conform with the arena design~ Important factors controlling acoustics are; (a) Upholstar¥ of the ~eat~. (b) Bottom of the seats. (c) Angle of the seats when the seat is up. (d) Color of the sea'ts for over-all color coordination. (e) Installation of the seats and acoustical treatment of risers where the seats are to be installed. Mr. Dimmit reported that they would like to have control of these matters in order to insure the City obtaining the maximum and good facility desired° Further~ that this portion of the over-all job could be by segre- gated bid under their supervision. it appeared to be agreeable with the City Council to provide that the selection and specifications of the fixed seats be the responsibility of the Architect. 7~61 City Ha!l~ An. aheim~ Californi~a -COUNCIL MINUT. Discussion was held concerning the agreement as drafted, and it was determined that to clarify the ~'sprinkler system" it should be noted in the exceptions under the Architect's Responsibility, that the sprinkler system referred to "'landscaping sprinkler system". Mr~ Geisler reported on other modifications and changes to the first draft of the contract and as agreed to concerning the following:' (a) The size of the prints. (b) Progress Status Report and Progress Payments. (c) Responsibility of Architect and Contractor will achieve to correction of error in design and plans, and/or misinterpreta- tion of design and plans~ (d) Expanded area of discretion on the part of city inspection. (e) Revision of fee scheduled for payment of preliminary schematics for 'the theater~ (f) Determination of specified amount of first payment, and progress payments for supervision. (9) Bid date (Suggested December 1, 1964), and completion date ? tSuggested Labor Day~ September 1966), Mro Geisler further advised that effort would be made to have the contract in final form for Council consideration at the next meetin9. Dorothy Jean Reagan, was reviewed by the City Council. On t'he recommendations of the Chief of Police, Councilman Dutton moved said Entertainment Permit be granted for a period of one year. Slagle, President, Yellow Cab Company of Northern Oran9e County, Inc~, dated Febru- ary 19~ 1964, for permission to transfer, taxicab permits from two old units {1957 Piymouth, Serial Noso 25222383 and 25222874) to two new units (1963 Dod9es~ Serial Nos. 4832 111851 and 4832 118786) was sub- mitted, and authorized on motion by Councilman Chandler, seconded by Councilman Schut%eo MOTION CARRIED. Mr. $1agle was present and submitted a letter dated March 2~ 1964~ requesting an additional transfer of taxicab permits from two old units (1960 Dodges, Serial Nos. 48-05113355 and 48-05113387) to two new units (1963 Dodges, Serial Nos~ 4932-11684~ and 4832-11g~66). it was moved by Councilman Dutton, seconded by Councilman Chandler that the two additional permits verbally requested by Mr. $1agle be approved, subject to 'the payment of the required $5 application fee. MOTION CARRIED. SIGN APPLIC.ATION - SAN MATEO P. ROFESSiONAL BUI. LDING.: Application submitted by San Marco Professional Building~ 3321 West Lincoln Avenue, requesting permission to erect a non-conformin9 double faced sign, was reviewed by the City Council~ together with plans and reports from the Building and Planning Departments° On motion by Councilman Schut'te, seconded by Councilman Du%%on~ said sign permit was granted as requested subject to any lighting being reflected away from the adjoining residential premises. MOTION CARRIED. 7562 C. it¥ Hall.~ A.naheim~ California -COUNG..!L MINUTES - March 3~ 1964~ 1:30 RECLASSIFICATION NO. 62-63-11: Request of Mro .John V. Thompson to revaluate Council action relative to Reclassification No. 62-63-11 (Ordinance No. 1867) to require a wall to be extended on the west side of subject property, was submitted together with report of City Engineer and Plan- ning Department-Development Review. Property located on the north side of Orangewood Avenue~ approximately 630 feet west of Haster Street~ ~r. Geisler reported that Mr. Thompson was present and wished to make a %ape recording o-~ 'this issue, it was apparent that the City Council had no objections to the .makin9 of a tape recording~ yecognizing that once the minutes of this meeting 'were approved by the City Council they became the official record~ Mro John V. Thompson, 335 West Orangewood Avenue, advised that the purpose of his request to tape 'this issue~ was for his own informa- tion to see what he might have omitted in his plea. ~Lr. Thompson further advised 'that he was absent from the city a great deal of time~ and 'mas unaware of a provision of an ordinance effecting property adjacent to 'his property on the east. ~gro Thompson in briefing the Council concerning the adjacent property, advised that the original permit was obtained by Stanley G. Anderson for the construction of Garden Apartments~ to which he had no objection$~ He ad,wised of sub,sequent ownership transactions relative subject property and reported that 'the property was presently owned by V.L.N. Construction Company~ and the plan originally 9ranted Anderson has not been car~ied ou't~ in the sense that the 'type of apart- ments has been changed. Mr~ Thompson stated that he finds a street projected in the plans extending northerly from Orangewood Avenue, and why a street has been projected, one half 'thereof to come from his property~ he did not know, as 'the proposed 64 foot street would go nowhere and dead'ended approximately 660 fee~ ?~o~th of Orangewood Avenue where there presently exists a high line steel tower which would be in the middle of the s~reet. He reported that upon checking into this matter~ he was advised that the proposed street was drawn in 'the plans to provide access to the center of lhe quarter section° He slated tha~t 'this quarter sec'tion of property has no ingress or egress from the ~street surrounding it to the cen~er area other than an easement that extends easterly from Harbor Boulevard. Mr o Thompson stated that ali other property has been protected from the trespasser~ of the many apartments in the area with the excep- tion of his citrus grove° He requested relief from this situation, by the installation of a chain-s, link fence of equal height~ with a gate lockable on his side of the property, to allow his use of an easement to his pump which is located on the former Anderson property~ Report of the C~'ty Engineer 'mas again referred to~ wherein it was noted 'that a bond in the amount of $4,000~00~ for a two ,year period, has been posted to insure installation of a six foot masonry wall along the west property lineo Mr. Thompson stated that he has lived on the property since 1934, and was only interested in protection. He reported incidents of intrusion on his property~ such as children playin9 in the 9rove, trash deposited on the property~ etc~ and further advised that he recognized a wall would be of 9rearer value in protection afforded than a chain-link fence. Mayor Coons~ summarizing 'the discus$ion~ noted that Mr. Thompson stated that a chain-link fence would serve the purpose~ and in referring to the City Engineer's report, noted that a bond in 'the amount of $4,000.00 has been posted to insure the installation of the masonry wall, and there- upon asked the City Attorney if the City could require a chain-link fence be installed at this time~ 7563 City Hal!~ Anaheim~ Ca,llforni~a - C.OUNC,IL MINUTES - March 3~ 1964~ 1:30 P.M. Mro Geisler replzed~ without further research, the indication to him would be that the City could not require the installation of a chain-link fence and also require the installation of a masonry~.wall if the chain-link fence pz~oved to be inadequate; further, that'the installation of a chain-link fence at this time, would not release the requirement of a masonry block wall unless the ordinance was modified to so specify~ Mayor Coons expressed his doub'ts that the Thompson property would remain a citrus grove indefinitely, and felt that sooner or later the property would be put to another use~ Mr o Thompson reported that there are two pending situations invoiving his properZ¥ and others in the area, which wouid be fronting on Harbor Boulevard and that nei'ther are similar to the developments adjoin'ting the properties° Discussion was held concerning the type of wall or fence that should be required~ and the location thereof, taking into con- sideration the expense i'nvolved in removal of the fence or wall should the full 64 foot street materialize° Mr~ Thompson agreed it would be unfortunate to later require removal of 'the fence, and further agreed to consider some arrangements relative to the location of the fence. Councilman Chandler asked what protection a fence would afford unless 'the entire grove was enc losed~ Mr~ Thomp~on advised that the wall has been completed north of 'the apartment property~ and that his reque$~t is to extend the wall southerly along their 'west boundary to Orangewood Avenue; in his opinion, chances of intrusion would be much less from the frontage of his property 'than from the entire easterly boundary° Reasons were dis,cussed for the future street projection, and it was noted rthat the proposed street was recommended to extend northerly to a point~ and 'then westerly to Harbor Boulevard to provide circulation° Mr. Thompson called attention 'to the existing permanent easement extending from Harbor Boulevard, approximately into the center of the block of proper'ty and felt the proposed street was not needed. He asked how the addi~tionai land needed for such street would be acquired~ and advised 'that if it was taken from his property, he would definitely re$ist~ as in his opinion it would be the taking of property without due process° ~k'o Geisler reported that the matter of ordinary and necessary access by streets through areas when developed, is an obligation and function of 'the Cit'y upon approval of plan to be certain the area will be developed r~cognizing th~ need for circulation and access of 'vehicles, police and fire protection, Request of ~r~ Thompson was again noted~ and it was determined that substitution o~ a chaln-link fence in lieu of the required masonry. wall~ would necesitate a variance action~ At the conclusion of the discussion, it was moved by Councilman Chandler, seconded by Councilman Schutte, that action on said request be deferred 'to the next mee'tin9 ':iMarch 10, 1964~ 1:30 P.M.) to allow visual inspec~tion of the a:rea by the City Council.
