The City Council of the City of Anaheim met in Adjourned Regular Meeting for the purpose of canvassing returns of the Special Election held Tuesday~ August 7, 1953, counting the Absentee Vote~ and declaring the results of the election, and t© handle any other business coming before said City Council. PRESENT: COUNCIL~N: Wisser, Heying and Van Wagoner. ABSENT : COUNCIL~N: Pearson and Boney. CITY ATTORNEY, PRESTON TURNER: Present. CITY ADMINISTRATIVE OFFICER~ KEITH A. N~3RDOCH: Absent. The City Clerk called the meeting to order for the purpose of electing a Mayor Pro Tern for the City of Anaheim. Councilman Van Wagoner nominated Councilman'Heying~ Mayor Pro Tern for the City of Anaheim and moved the nomination closed. Councilman Wisser seconded %he :.motion. ~OTION CARRIED. Mayor Pro Tern Heying was seated.. iBALL ROAD ANNEXATION NO. ?: Mayor Pro Tern Heying appointed himself as Inspector, Councilman Wisser and Councilman Van Wagoner to act as Judges and Clerks in the handling of Absentee Ballots and in the canvass of the semi-official returns of the election officers. The City Attorney ruled upon the procedure governing %he election process. Semi-official returns were read. The Public was invited to participate in the checking and inspection of the Absentee Voter and did actively participate in said inspection and checking. WHEREAS, the City'Council of the City of Anaheim has canvassed the re- turns of a certain special annexation election held on the 7th day of August~ 1953, in certain unincorporated territory sought to be annexed to said City of Anaheim~ designated as BALL ROAD ANNEXATION NO. 2~ and WHEREAS, said City Council has caused a record to be made of the canvass of returns of said election~ which record in entitled RECORD OF CANVASS OF RETURNS OF SPECIAL ANNEXATION ELECTION HELD AUGUST 7, 1953. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that said record of canvass of retruns of said election be, and the same is hereby ordered entered upon the Minutes of said City Council. RECORD OF CANVASS OF RE/URNS OF SPECIAL ANNEXATION ELHCTION_ HELD AUGUST 7; 1953. The City Council of the City of Anaheim hereby makes a record of canvass of returns of a special annexation election. Said special annexation election was held on the 7th day of August, 1953 in the manner provided by law. That for said election, said City Council duly established one voting precinct which is designated as BALL ROAD ANNEXATION NO. 2 ELECTION PRECINCT. That the polling place for such election was established and maintained at Orange Grove Trailer Park - Business Office, 913 South Palm Street~ Orange County~ California~ which was within the hereinafter described unincorporated territory. The description of the property proposed to be included in the annexation known as the BALL ROAD ANNEXATION NO. 2 is as follows: A tract of land lying within sections 15~ 16~ 21 and 22~ township 4 south, range 10 west, san Bernardino Base and Meridian; bounded on the east by the E line NW~. NE~ of said section 22~ on the south by Winston Road extended to Walnut Street, South on Walnut Street to Cerritos, West on Cerritos to the Southerly extension of Loara Road~ north on Loara Road~ and its southerly ex- tension, to Lincoln Avenue, bounded by the existing City Limits on the north and east, and more particularly described as follows: Beginning at the point of intersection of the E. line of the N~k~- of NE~, Section 22~ T4S, RiOW~ S.B.B.M. and the existing City Limits being 660' more or less southerly of the monumented center line of Ball Road (60 feet 'wide); thence 1. That the proposition submitted to the electors residing within said unincorporated area was: Shall "BALL ROAD ANNEXATION NO. 2" be annexed to the City of Anaheim, California, and the property in said BALL ROAD ANNEXATION NO. 2~ be after such annexation~ subject to taxation equally with the property within said City of Anaheim~ to pay its pro rata portion~ based upon assessed valuation of all bonded indebtedness of said City o£ Anaheim outstanding on June 9~ 1953~ or theretofore authorized? YES That said City Council met at its regular meeting after the expiration of three days from and after the date of said election to canvass the returns of said election, to wit, A~gust 11, 1953,1and at that time continued the canvass of returns to an Adjourned Regular session on Monday~ August 24~ 1953 to make and complete its canvass of such retruns. That from and by its canvass of such returns, said City Council finds: 1. That the whole number of votes cast at such election was 93. 2. That the number of votes cast at such election in favor of annexation was 43. 3. That the number o£ votes cast at such election against annexation was 50. 4. That the number of ballots received as absentee votes was 12, of which 2 ballots were rejected and that 10 were found to be valid absentee ballots. 5. That the number of absentee ballots received in favor of annexation was 9. 6. That the number of absentee ballots received against annexation was 1. 7. That the total number of votes cast, including absentee votes~ favoring annexation was 52. 8. That the total number of votes cast~ including absentee votes~ against annexation was 51. E. ORDINANCE NO, 860~ Councilman Van Wagoner introduced Ordinance No. 860 and moved for its passase and adoption. Said Ordinance was re~d in public in full for the first time. AN ORDINANCE OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO SAID CITY OF ANAHEIM OF CERTAIN INHABITED TERRITORY KNOWN AS BALL ROAD ANNEXATION NO, 2., 492 .... City Hall~ Anaheim, California, August 24, 1953- 8:00 P.M. Mayor Pro Tem Heyin9 declared the business of annexation, closed, as per- taining to Ball Road Annexation No. 2. COUNCILMAN PEARSON was granted permission to leave the State on motion by Councilman Van Wagoner, seconded by Councilman Wi sser. MOTION CARRIED. COUNCILMAN HEYING was granted permission to leave the state on motion by Councilman Wi sser, seconded by Councilman Van Wagoner. MOTION CARRIED. AUCTIONEER'S BOND (Ted M. Custafson) and Pf]JMRFR.q' P~D (Lela Mae Salisbury) d.b.a. Hol!ydale Plumbing Co. were approved by the City Attorney, and ordered filed on motion by Councilman Wisser, seconded by Councilman Van Wagoner. MOTION CARRIED. CONSENT TO REDEL INCORP. for the storage on premises leased from the City of Anaheim of explosives, inflammable or dangerous substances, or liquids to the extent permitted by the standards established by the National Fire Protection Association adopted May 11, 1951 was granted and the Mayor and City Clerk authorized to sign said consent on motion by Councilman Wisser~ seconded by Councilman Van Wagoner. MOTION CARRIED. M,W,D. TAX RATE; The Metropolitan Water District of Southern California submitted its certified copy of Resolution No. 4294 levying a tax for the fiscal year 1953- 1954 upon property taxable by said district including taxable property 1yin9 within the City of Anaheim. Tax for Bond and Interest requirements, 19¢- For district operations 6¢ - Total 25¢. The City Clerk was instructed to advise the County Tax Collector that the Metropolitan Water District Taxes be certified to the County Auditor, to be collected in the same manner as outher County Taxes, over and above the established rate of $1.10 set by the City of Anaheim, on motion by Councilman Van Wagoner, seconded by Councilman Wi sser. MOTION CARRIED. APPOINTMENT: PATROLMAN' Chief of Police, Mark A. Stephenson, appointed James Theodore Evans as Patrolman on the City of Anaheim Police Department. Said Patrolman was sworn in by the City Clerk. Councilman Van %~agoner moved that appointment be ratified, subject to the approval by the Administrative Officer. Councilman Wisser seconded the motion. MOTION CARRIE D. ..REFUND~ BUSINESS LICENSE,.: Communication from Mrs. W. A. Franz requesting refund on License paid for the year commencing July 1, 1953 by Bill Pranz~ 1129 W. Center St. who has discontinued business due to serious illness, was submitted and read. Councilman Van Wagoner moved that refund be authorized on a pro rata basis. Councilman Wisser seconded the motion. MOTION CARRIED. TRANSFER OP ~lJNDS: Transfer of $13~390.00 from the General Fund to the Recreation Fund was authorized on motion by Councilman Van Wagoner, seconded by Councilman Wisser. MOTION CARRIED.
