None The Mayor declared Resolution No. 6~R-333 duly passed and adopted, SIGN - RE..,q,UES.T FOR. RECONSI~DERAT!ON:' Submitted by Electrical Advertising, Inc,, on behalf of Reliable Mortgage Company, for permission to erect a non- conforming sign at 2295 West Ball Road. Mayor Chandler asked the applicant if there were any changes in the plans from those submitted at the April 28 meeting. Mr. Tompsett, representing the sign contractor, advised that there were no physical changes in the plans~ however the plan presented was a structural plan and did not indicate dimensions. Plans showing dimensions were reviewed by the City Council, and it was noted that no change had been made. Mayor Chandler announced that the consensus of Council opinion was that the request for reconsideration be denied, and further suggested that the applicant contact the Building Department concerning the existing roof signs which were in conflict with the proposed sign regulations, as this was the basic reason for denial. SIGN - REQUEST FOR RECONSIDERATION: Submitted by Raymond G. Spehar (Owner of the property) concerning application for free-standing sign submitted by Lucky Liquor Store, 1761 West La Palms Avenue, denied by the City Council May 5, 1964, at which time it was indicated that said sign should be designed as an integra±ed sign. Mr. $pehar presented a rough draft of an integrated sign and advised thai the sign presently located in the center of the property was owned by the tenant of the Beauty Shop, howeve~ he felt this could be worked out and the existing sign removed and replaced by the integrated sign now proposed, thereby eliminating the two existing signs on the property. Plans submitted by Mr. Spehar were reviewed by the City Council. On motion by Councilman Dutton, seconded by Councilman $chutte, action taken by the City Council May 5, 1964, denying sign application, was ordered reconsidered. MOTION CARRIED. 7788 City Hall~ Anaheim~ California -COUNCIL MINUTES - May 12~ 1964~ 1:30 P.M. On motion by Councilman Dutton, seconded by Councilman Pebley, sign application was granted, based on the plans submitted this date re- placing the two existing signs., and further subject to no projection over the property line, and subject to structural requirements of the Building Department. MOTION CARRIED. (Plans signed and dated this date by Mayor Chandler) .S. IGN REQUEST: Submitted by Benjamin and Mayer, requesting permission to erect a free standing sign at 420 South Euclid Street, was reviewed by the City Council together with plans and reports from the Building and Planning Departments. (Marshall Darnall Realty) Mr. Walter L. Brooks, 2312 South Susan Street, Santa Ana, California~ addressed the Council explaining the features of the sign, and displayed a colored rendering of the proposed sign. (Rendering retained by Mr. Brooks) On motion by Councilman Krein, seconded by Councilman Dutton, said permit was granted subject to no projection over the property line, and arrangement of lighting to be reflected away from residential property. MOTION CARRIED. .RECLAS$IFICAIION NO. 59-60-39: Request of Russel O. Roquet, for approval of revised plans pertaining to property briefly described as located on the west side of State College Boulevard between Center and Redwood Stree%s~ (429 North S~ate College Boulevard) was submitted. Revised plans were compared with last approved revision, and it was noted that the change was to locate the building on the north portion of the lot rather than the south. On motion by Councilman Pebley, seconded by Councilman Dutton, revised plans were approved subject ho the following conditions- . . . Construction of a minimum 6-fool masonry wall to be measured from the highest property level along the north, west, and southern property line. Provision for a 3-foot planter area along the frontage of the parking lot, and the area remaining between the end of the building and the edge of the sidewalk of property line to be pZanted and/or landscaped. Construction of driveway approach and sidewalks, o~ the postln9 of a bond in an amount of $600 to insure said construction. MOTION CARRIED. Mayor Chandler left the meeting, (2..35 P.M.) and Mayor Pro Tem Dutton assumed Chairmanship. RECLASSIFICATION NO. 63-.64-46 =. EXTENSION OF TIME: Request of Locnil Inc., for six months extension of time to Reclassification No. 63-64-46~ pertaining to property briefly described as located on the south side of Lincoln Avenue, approximately 365 feet west of Westchester Drive, was submitted and granted~ on motion by Councilman Krein, seconded by Councilman Schutte. MOTION CARRIED. JOB NO. 821 - EXTENSION OF TIME: In accordance with recommendations of the Engineer~ sixteen working days extension of time was granted the Earnest A. Redfearn Construction Company~ Contractors~ on motion by Councilman Pebley, seconded by Councilman Schutte. MOTION CARRIED. CHANGE ORDERS NOS. 2 AND 3~ JOB NO. 797: On the recommendations of the City Engineer, Councilman Krein moved that Change Order No. 2, in the amount of $683.20~ consisting of extra work required~ and Change Order No. 3~ in the amount of $5,288.05, consisting of an adjustment in estimated work quantities to the quantity of work actually constructed~ Job No. 797, be approved. NG APP.,LICATION FO.RMS: Mr. Davis advised that, pursuant to request of the City Council, investigation has been made concerning the possibility of a single form for all Reclassifications, Variances and Conditional Use Permit Applications, /he Planning Department Staff to determine which type of permit would be necessary for each use applied for. Mr. Geisler reported that former City Attorney Preston Turner had prepared a form for the multiple purpose application, alon9 with another form for the resolution, applicable to any of the various zoning actions, which could be used by the City Planning Commission. He was of the opinion, however, that the procedure could not be adopted, due to the advisory capacity of the City Plannin9 Commission, which recommends to the City Council the action to be taken on requests to rezone property, and the Commissiongs administrative action on Conditional Use Permits and Variances is subject to appeal and possible reversal by the Council. On a combined application every action would be an application for reclassification and require Public H~aring before the City Council. At the conclusion of the discussion~ it was the consensus of Council opinion that the proposed combination of zoning application and resolution forms would be impractical. Mr. Kreidt noted the location of subject property, the existing uses and zoning in the immediate area, briefing the evidence submitted to and con- sidered by the City Planning Commission a~ their public hearing held yesterday. Mayor Chandler asked if the Applicants or their Agent was present and wished to address the City Council. Mr. Harry Knisely, Attorney for the Applicants, advised that the primary issue has appeared to be the layout plan for the proposed development, and noted that in the opinion of ±he Architect for the project, the plans allow more open area than the Planning Staff suggested, and the layout is such that the pedestrian and vehicular traffic do not intersect. He further advised that they have made an effort to maintain the elements of privacy along with provisions for good recreational facilities. Plans and the files were reviewed by the City Council, and the Mayor asked if anyone wished to address the Council in favor of the proposed develop- ment, there being no response, asked if anyone wished to be heard in opposition. Mr. A. j. Radoccia, 2441Gtencrest Avenue, representing residents in the area called attention to petition of protest filed at the Ci±y Plannin9 Commission hearing. He referred to traffic count statistics for Gilbert Street and Cresent Avenue obtained from the City Traffic Engineer, and noted these two streets were secondary streets incapable of carrying the amount of traffic generated by the proposed development, and widening of these streets would be unlikely because of the location of the Flood Control Channel and retarding basin. Mr. Radoccia cited the over-crowded conditions of the schools in the areas and called attention to a letter filed noting enrollment figures as compared to capacities of schools in 'the immediate vicinity. Mr. Radoccia advised of {he unique character of subject property which in his opinion ~hould be developed similar to the existing single- family development in the area and requested the City Council consider their wishes and deny said application:~. Mayor Chandler asked if anyone else wished to address the City Council in opposition to the reclassification. There was no response. Mr. Knisely, in rebuttal, r~tated that according to the staff report dated February 6, 1964, existin9 and proposed school and park facilities would accomm~;date any increase generated by the proposed development, and Crescent Avenue and Gilbert Street could accommodate any increase in traffic. Mr. Radoccia requested thai the aforementioned statistics re-~ 9arding traffic count and school enrollment be read. Mayor Chandler read said statistics from the letter dated May 8, 19642 addressed to 'the City Planning Commission. In an:ewer to Council questioning, the City Engineer reported that the Flood Control District provides t~o~lane bridges, and the City widens said bridges as necessary to ac¢omm.odate ~rafflc, both subject streets are projected ~or 90-,~oo± right-of-way. At the request of a gentleman in the audience, those persons present. in opposition to subject application:s, stood in recognition. Mayor Chandler advised Mr. Knisel¥ and the principals involved, of the future plan to light the golf course and that illumination will be close to the south boundary of subject property. Councilman Dutton was of the opinion that the proposed development was a proper use for the property, and thereupon offered the three resolutions necessary to accomplish said development subject to conditions noted below. Discussion was held prior to roll call vote on said resolution, and Councilman Krein was of the opinion subject property should be restricted to R-1 development, and further noted denial of R-3 zoning to adjacent pro- perty to the west. Mayor Chandler was of the opinion that both the R-1 property in the area and subject property must be given consideration, and referred to the single-story construction requirement wi(hin 150-feet of low density re- sidential property; a requirement for the protection of residential property under these circumstances. Further, in his opinion, no dif{ereni conditions exist to subject property and the property located at the northeast corner of Crescent Avenue and Gilbert Street on which R-3 zoning was obtained without opposition. RESOLUTION NO.. 64R-345: Councilman Dutton offered Resolution No. 64R-345 for adoption, authorizing preparation of necessary ordinance, changing the zone as requested, subject to the following conditions: 1. He called attention to a prior applica- tion, Conditional Use Permit No. 397, for a walk-up restaurant with waiver of required parking provision, which was denied without oreiudice. Mr. Kreidt briefed the evidence submitted to and considered by the City Planning Commission, and findings resultina in their denial of Conditional Use Permit No. 556. ~ In answer to Councilman Dutton~s question, Mr. Kreidt reported that no plans for the properties comprisin9 the balance of the block have been con.sideredby the City Planning Commission. The City Clerk submitted into evidence and read in full letters of opposition to the proposed use from Edith Stillians, 123 North Resh Street, and ,foe Sowder, 125 North Resh Street. The Mayor asked if the Applicant or her Agent was present and wished to address the City Council. Mr, ,James L. Morris, Authorized Agent for the Petitioner, advised that the size of subject lot has caused difficulty in determining a use which would require the small number of parking spaces that can be accom- modated on the property: that the building proposed under Condiditional Use Permit No. 397 was approximately three times the size of the one now proposed, and parking is now only minus one space of meetin9 code provisions. Mr. Morrls failed to see any detriment to 'the area in an attractive Orange Julius. He called attention to several other walk=.up restaurants in the area along Lincotn Avenue, and further advised that according to his own survey, nine walk-up restaurants had been established in the City of Anaheim with inadequate parking according to the Anaheim. Municipal Code provisions. Mr. B. B. Quirk, 2072 Flippen Drive, National Real Es%ate Director for the Orange Julius Company, addressed the Council reporting that his company has been in business for 38 'years during which there has never been a failure. He advised of the new design for their buildings, displaying a rendering in color, and noted other sites in Orange County where similar installations are bein9 constructed, in addition to the orange drink, their entire menu consists of hamburgers and ~hot dogs", and 40 percent of their Orange Julius drink sales are taken home. in answer to Council questioning, Mr. Quirk advised that the pro- perty located in the City of Santa Aha, currently under construction for a similar facility, was not as large as subject property; and he further noted that plans for subject lot are for ingress from Lincoln Avenue, with egress to Citron Street. Mayor,'Ohandier asked if anyone else wished to address the Council in favor of the proposed use, 'there being no response asked if anyone wished to offer opposition, Mr. Visser, 701 West Lincoln Avenue, addressed the Council in opposition, stating that although he had no plans available at this time, he was desirous of developing the entire frontage along Lincoln Avenue to a use which would be a credit to the community, and for that reason he had o~ered to purchase subjec't property a< a figure based on appraisals, made, or sell adjacent lot 'to them for the amount he paid so that a nice development can be realized, He called attent:on to the future widening of Citron Street which would further reduce 'the lot frontage along Lincoln Avenue. Wr. Visser also noted 'that there is little pedestrian traffic in this area with the exception of students from the Junior and Senior High Schools.
