The City Engineer reported that the developer of Tract No. 5489 has indicated that the tract may not be finalized in the immediate future. If the easement is reserveds Mr. Maddox had no objection to the proposed abanJonment. Councilman Schutte moved that Council determination regarding proposed abandonment of a portion of Gum Road be continued three weeks (June 30, 1964. 1:30 P.M.) pending further investigation and report fro~ the City Attorney. Dudics. was submitted requesting hearing on Reclassification No. 63.-64-77 and Conditional Use Permit No. 532~ on the basis of increased traffic on Crescent Avenue and Gilbert Street. Councilman Dutton called attention to Item No. 2 of the Inter- departmental Committee report to the City Planning Commissions dated February 3, 1964s which stated that the proposed multiple-family residential development has no substantial implication on the provision for public facilities such as streetss parks and schools~ and said development could be accommodated by existing facilities and traffic increase can be accom- modated by Crescent Avenue and Gilbert Street. Pursuant to said. report, Councilman Dutton was of the opinion that no new evidence has been pre- sented to warrant further public hearing. On motion by Councilman Dutton, seconded by Councilman Krein, request _~or re-hearing on Reclassification No.'~63-64-77 and Conditional Use Permit No. 532 was denied, and the City Clerk was instructed to so notify Mr. Dudics. Dobbs, 1837 South Jacalene Lane, advised that while the motel has been under construction on property between Casa Grande and Katella Avenues, there has been a problem with pedestrian and vehicular traffic from Stella Lane using bls driveway, which is adjacent to subject property. He further advised it was his understanding that possibly a five foot easement may be granted to the school by the developer of subject property, and he requested notification of any request for devia- tion in the plans approved by the City under Conditional Use Permit No. 506. Mr. Thomas Jeffrey, t828 Janette Lane, indicated his presence in the audience. In answer to Mayor Chandler~s question, Mr. Geisler reported that the school es jurisdiction would allow them to acquire a portion of subject property for u~e as a "wa lk- through~ under eminent domain pro- ceedings, which would not constitute an easement. He was of the opinion that a voluntary transfer of a part of the property by the developer to the school could render the conditional use permit inoperative. Mr. Thomsen 'was present and reviewed minutes of the Anaheim Cliy Council meeting held May 14, 1963, advising it was his understanding thai he would install street improvements along the West Street frontage only, and that the City would be responsible for all improvements along North Street in exchange for dedication of property to accomplish re- alignment of the intersection. He requested clarification of the side- walk requirement on the North Street frontage, and asked if it was the Council °s intention to waive sidewalks on the North Steer frontage. Council discussion was held, and it was noted that it has been the policy of the City Council to assess the $25 per unit park and recrea- tion fees on R-A parcels subdivided and developed with single-~ami, ly dwellings, as well as on R-I construction on lots which are formed by splitting R~A parcels by means of a Record of Survey. Mr. Dave Hook, of Sunset Builders, Agent for the Petitioners~ advised that future plans called for two ~hree-stor¥ office buildings to be constructed on the easterly portion of the property~ Because 'the site is situated four feet below ground level, foiur-foot retaining wails are planned, with an additional 24 inch masonry wall above grade, Mr. Hook displayed a large rendering in color illustrating the apartment building and proposed future office buildings, and advised that ample parking for the entire development has been incorporated, in the plans, with subterranean parking provided for the apartment building.
