ON: Mayor Chandler proclaimed the period of November 20 to 26, 1964, Farm-City Weeko LOCAL AGENCY FORMATION CONB4ISSION: Notice of meetings to be held by the League of California Cities for the purpose of considering the evaluation of the performance, and suggestions for legislative changes for 1965, pertaining to the Local Agency Formation Commission~ was submitted. On motion by Councilman Schutte, seconded by Councilman Pebley~ the Mayor and representative from the City Attorney"s officer were authorized to attend the meeting scheduled to be held in San Diego, November 10~ 1964. EXECUTIVE SESSION: It was reported that the Stadium Commission has requested an Executive Session with the City Council for the purpose of discussing the confidential features of employment and information received specified to be confidential in nature, relative to the employment of a Stadium Concess- ionaire° ADJOURNMENT: Councilman Schu%te moved to adjourn to November 4~ 1964, 11:00 and also moved waiver of further notice of said adjournment. SHOPPER'S MA~L, Further consideration of the City's participation in the proposed Downtown Shopper's Mall (100 block - West Lincoln Avenue), was continued to this date for revised report on funds to he advanced h¥ the City for its portion of said improvement and estimated cost therefor. On report by Mr. Murdoch that Mrs. Ulvestad, Chairman of the Project Committee, has requested postponement, the City Council continued further consideration for one week (November 10, 1964, 1~30 P.M.) CQNVE~TION HALL - REVISION TO PLANS (C~ANGE ORD.~R), The City Manager reported on proposed revision of plans for the Convention Hall Facility to orient the facility towards the 15 acre parcel fronting on Harbor Boulevard. (A portion of the Convention Center site approved h¥ the City Council for acquisition October 27, 1964). ~ Mr. Murdoch read letter dated November 4, 1964, from Adrian Wilson, Architect for the project, setting forth a hreakdown of pro-rated costs for necessary retracing and modification to the plans, totaling $28,200.00. Said letter further stated that the maximum delay would he 30 days beyond the original scheduling, with 10~ percent completed drawings ready for submission to the City of Anaheim hy January 22, 1965. Councilman Krein requested the record to show that he was not in favor of selling or leasing at this time any portion of the Katella Avenue frontage included in the Convention Center site. Councilman Dutton was of the opinion that the re-orientation of the Convention Center would he significant to the maximum utilization of the 15 acre parcel on Harbor Boulevard, as it relates to the facility, accomplishment of this purpose being worth the additional expense. At the conclusion of the discussion, on motion hy Councilman Dutton, seconded hy Councilman Schutte, $28,200.00 additional expenditure was authorized to reverse the plan to orientate the frontage of the Convention Facility to Harbor Boulevard. A~COHOLIC BEVERAGE LICENS~ - TRIANGLE RESTAURANT~ City Attorney Joseph Geisler reported that the Alcoholic Beverage Control Board has granted the On-Sale Beer and Wine License for the Triangle Restaurant, 1126 North Anaheim Boulevard, over the protest filed hy the City of Anaheim, He noted findings made hy the Board, which were not entirely correct, and was of the opinion that attention of the Alcoholic Beverage Control Board should he called to this fact. e On the recommendations of the City Attorney, Councilman Dutton moved that Mr. Geisler be authorized to forward a letter to the Alcoholic Beverage Control Board on behalf of the City of Anaheim, waiving the 30 day appeal rights to said license, and further noting corrections to the findings of the Board in granting said license. Councilman Schutte seconded the motion. MOTION CARRIED. ALCOHOLIC BEyE~AGE LICENSEE ,APPLICATION r DEE'S RESTAL~IANI, Mayor Chandler referred to application by Anthony and Audrey De Piano for New On-Sale Beer and Wine License for Dee's Restaurant, a Bona Fide Eating Place, at 1750 West Lincoln Avenue (G-1 Zone), which was conditionally protested 8188 Cit~ Hall, Anaheim. He reported that a conditional use permit application has been filed hy the applicants, and because of the necessary time to process said applicantion, advised that they are requesting the City to withdraw the protest, pending final determina- tion of conditional use permit. On the recommendation of the City Attorney, the City Council determined that the conditional use permit application must he processed prior to withdrawal of the protest filed with the Alcoholic Beverage Control Board as a license can not he issued in conflict with zoning. qON?IN.L.~/ED ~ISBLIC .HEARING - A~.AN~NMENT, Continued to this date for further investigation and report hy the City Engineer was public hearing on pro- posed abandonment of an easement for avenue and public utility purposes, reserving therefrom an easement for public utility purposes, property described in Resolution No. 64R-715 (Southside of Cerritos Avenue, one lot ~est and two lots east of Dallas Drive - Tract No. 3247). Mayor Chandler asked if anyone wished to address the Council for or against the proposed abandonment. City Engineer James P. Maddox submitted map for Council review, illustrating the development of the various tracts in the area, and reported that the parcel proposed for abandonment requires no further street construc- tion. Further, investigation of the parcel, and 12 inch to 18 inch probing revealed no large pieces of concrete apparent on or below the surface. He was of the opinion that permission from the owner of adjacent property to the north to place the sign at the property line would be difficult to obtain. On motion by Councilman Krein, seconded by Councilman pebley, Council action on said sign request was deferred one week (November 10, 1964, 1,30 P.M.) to allow the applicant an opportunity to obtain consent from the owner of the adjacent Desert Inn Motel. QASA ROMA: Application and plans submitted by Liberto Development Company for free-standing sign for restaurant at 1730 West La Palma Avenue, was reviewed hy the City Council together with reports from the Building and Planning Departments. Mr, William Barker, of Federal Sign and Signal, reported that the requested sign could he relocated, and called attention to the six shops in the building in addition to the restaurant which is located at the extreme west end of the property. On motion by Councilman Dutton, seconded by Councilman Pebley, said sign permit was granted, subject to no projection over the property line, and further subject to location of the sign within the center 10 percent of the property. R~CLA$$IFICATION NO. 62-63~63 AND~QNDITIONAL USE. pERMIT NO, 354 - REVISED PLANS, Revised plans submitted by Covington Brothers in connection with Reclassi- fication No. 62-63-63 and Conditfdnal Use Permit No, 354, together with reports from the Planning Department and City Engineer, were reviewed hy the City Council and compared with plans formerly submitted. BUILDING ADDITION - ~45~ .GLENOAK$ AVRNUE~ Communication dated Octobe~ 21, 1.964, from Cyril G. and Bernice C. Schneider requesting clarification and enforcement of Anaheim Municipal Code side yard setback requirements concerning building addition on adjacent, residential property, was reviewed hy the City Council together with report from the Planning Department. Mro Geisler reported that plans for an addition to the Worley dwelling, 2433 Glenoaks Avenue, were approved by the Building Department with a five foot setback from a fence between subject property and the Schneider residence at 2429 Glenoaks Avenue. During construction, it was discovered that said fence had been constructed six inches from the Schneider property line, and as result, the construction on the Worley property was six inches short of the five foot minimum setback requirement. Pursuant to complaint made to the Building Department by Mr. and Nlra. Schneider, the construction was temporarily stopped to allow for full investigation° Mayor Chandler read report dated October 23, 1964 from the Planning Department (copies furnished each Councilman) which concluded that the error was minor in nature and did not warrant application for variance, Nits. Bernice Schneider was of the opinion that Ntr. and Mrs. Worley were aware of the fact that the existing fence was not on the property line. At the conclusion of the discussion, the City Council concurred with report from the City Planning Department and no further action was taken. EN~ERTAINN~NT PERMIT: Application filed by John J. and Carma J. Kuhne for entertainment permit to allow exhibition popular dancing with one or two employees participating, at The Can Can, 1224 South Brookhurst Street, was submitted. The City Manager read reoort dated October 23, 1964, from the Chief of Police recommending said permit be denied. On the recommendations of t?e Chief of Police, Councilman Krein moved said entertainment permit be denied. Councilman Dutton seconded the motion. 8190 City Hall. Anaheim. Mr. John Kuhne addressed the City Council calling attention to'the economic hardship caused them as similar entertainment is offered in neighboring cities~ and advised that they would like an opportunity to offer the same entertainment; that should a problem arise they would stop the entertainment. He thereupon requested that the matter he continued to allow him an opportunity to confer with the Chief of Police. Councilmen ]<rein and Dutton withdrew their motion and second to deny the application. On motion by Councilman Dutton, seconded by Councilman Krein, Council consideration of entertainment permit application for The Can Can was tabled one week (November 10, 1964, 1:30 P.M.) to allow the applicant an opportunity to confer with the Chief of Police, To this motion Councilman $chutte voted "No". Paul Hayes advised that meetings have been discontinued until the decision of continuing the committee or re.organizing the committee could be considered by the City Council as it was apparent some type of change was necessary to make it an effective body. .At the conclusion of the discussion, Mr. Hayes was requested to prepare a revision to the Anaheim Municipal Code, Chapter 6.08, Disaster Council, incorporating an Advisory Committee, for future Council consideration. That the City of Anaheim acquire the parcel of property described as the north-south alley and improve and extend said alley northerly to Romneya Drive. Said improvement will provide secondary access to the court's parking area and the Lemon Street,Anaheim Boulevard frontage properties. 3, That the westerly section of the east-west alley, from the north-south alley to Parry Street be retained as a necessary element of the secondary circulation system serving the court's parking area and frontage properties on Lemon Street and Anaheim Boulevard. 4. That the easterly section of the east-west alley, from the north-south alley to Lemon Street be abandoned. Discussion was held concerning the proposed establishment of a parking district and the acquisition for extension to Romneya Drive of the privately owned north-south alley. Also discussed was the need for the establishment of a policy for access to those properties fronting on Lemon Street, as well as to the municipal parking area to the west. In answer to Council questioning, Mr, Geisler was of the opinion that if the private alley was extended and improved as a public easement, it should be accomplished under the principle that a minimum of one half the costs he paid hy the abutting property owners, Plans and the files were reviewed by the City Council, and Mayor Chandler asked if anyone wished to address the Council. Air. E. W. Stinson, 1121 North Lemon Street, advised of the necessity for the alley to provide access to his garage, and for business deliveries to those properties north of his property. Further, he favored the C-2 zoning proposed on subject property. Mr. Stinson was advised that the southerly portion of the alley, behind his residence, was owned hy the City~ and not the area referred to for possible acquisition. The Mayor asked if anyone else wished to address the City Council for or against the proposed reclassification, there being no response, declared the hearing closed on Reclassification No. 64-65-14, General Plan Amendment No. 41, and Area Development Plan No. 10. Further discussion was held by the City Council, City Manager and City Attorney, and it was determined that a policy for development for the north-south alley he deferred to he again considered in connection with the development of the municipal parking area. The City Planning Commission pursuant to Resolution No. 1354, Series 1964-65, recommended General Plan Amendment No. 39 be disapproved. .~ Mr. Kreidt noted the location of subject property, the existing -.-"' uses and zoning in the immediate area, and summarized the evidence Submitted to and considered hy the City Planning Commission. He called attention to the three lots adjacent and extending southerly to La Palma AvenUe from subject lot, which were rezoned in 1963 to C-1 (Reclassification No. 62-63-122), and deed restrictions were recorded limiting said parcels to business and professional offices only including a pharmacy. He further reported that subject application would allow inclusion of subject property into plans for the development of said adjacent properties to provide additional parking facilities. Attention was also called to General Plan Amendment No. 39, Exhibit "A", posted on the west wall of the Council Chamber, and Mr. Kreidt noted the City Planning Commission"s recommended disapproval thereof, based on their opinion that the action on the one parcel did not warrant a change to the General Plan. Revised plans and the file were reviewed by the City Council, and it was noted that said revised plans included the three southerly lots as well as subject property. Mayor Chandler asked if anyone wished to offer opposition to the proposed reclassification. Mr. 3chh A. Fedor, 1021 Acacia Street, advised of the improvements made to his home adjacent to subject property on the north, and stated he had no objection to the medical center planned for the three southerly lots or subject lot being developed for parking, providing a 6-foot block wall be constructed to proteCt his property. He expressed concern that the proposed C-1 zoning on the lot adjacent to his property could result in the one lot being developed for a commercial use which would he objectionable. In answer to Mayor Chandler's question, Mr. Fedor stated he would have no ohj.ection to the C-1 zoning if recorded deed restrictions limiting the use of subject property, similar to the three lots south, were required, Mr. Harold Clasen, 1020 North Acacia Street, addressed the Council stating he was in agreement with Mr. Fedoras statements, however, he was of the opinion the action on the three southerly lots was hy conditional use permit, not C-i rezoning. Mayor Chandler asked if the applicants or their agent wished to address the Council. Mr. Paul Ruffing, 1333 South Euclid Street, representing the developers and the architects, advised that plans are for a medical clinic only, and do not presently include a pharmacy. Further, they are ready to proceed with immediate construction when the zoning is completed. POLICY REGARDING CURRENT R-3 DEVELOPMENTS: Mr. Geisler reported on the criteria Used in determintn~ whether developments were entitled to proceed under former regulations or newly enacted regulations. He briefed rules used by their office on decisions pertaining to M-1 developments at the time new conditions and requirements for development were enacted, as they .pertained to the issuance of building permits. Briefly, the following questions were asked: (1) Has the permit been applied for? (2) Has substantial money been spent on preparation of plans in conformity with old regulations? (3) Have any commitments for loans been made on the plans under old regulations? (4) Were plans connected with the reclassification submitted to the City Council in connection with the reclassification, and tied in to such reclassification; and in connection with the reclassification, have substantial sums been spent? Based on the answers or combination of answers to the four basic questions, determination would be made by the City Attorney"s office as to whether the applicant was entirely to develop under old regulations~ or should develop under new regulations; with an additional provision that no applications for relief from provisions would be processed by the City Attorney's office after a period of six months from the effective date of the ordinance establishing new regulations, On motion by Councilman Dutton, seconded by Councilman Schutte, policy as outlined by the City Attorney was adopted for the applications of the new R-3 regulations.
