Ognditional Use Permit No. 450: Petitioner for Reclassification No. 63-64-8 and Conditional Use Permit No. 450, requested permission to withdraw subject applications. The City Planning Commission pursuant to Resolution No. 1426, Ser%es 1964-65, recommended R-2 classification of Portion i and termination of ~roceedings on Portion 2. Further, Conditional Use Permit No. 450, filed in ~onJunction with subject reclassification, was terminated on motion of the City Planning Commission as requested. ~[r. Grudzinski noted the location of the property and advised that during the period of time the application was under submission by the City Planning Commission, Northeast Annexation #3 was finalized! that portiontol the property within the Northeast Annexation #3 (Portion No. 2) was recd,,sifted to the R-2 ~one, pursuant to an urgency ordinance adopted by Mr. Grud~inski fu~the~ advised that this ~gning matter has been before the City Planning Commission for some time, and continued from time to time for submission of plans, particularly involving adequate access to serve the number of units proposed for the project. Also during this tiAe the~property changed hands two or three times and plans acceptable to the City PIanning Commission were never submitted. Johnson for "The Alibi", 821 South Brookhurst Street, was granted for a period of one year in accordance with recommendations of the Chief of Police, on motion hy Councilman Dutton, seconded hy Councilman Pebley. Lewis and Frances A, Johnson, requesting change of zone from C-1 to~=3~ property briefly described as i107 South Anaheim Boulevard. Public hea~ing was continued from the meeting held December 15, 1964, for the purpose of determining access from subject property as it might relate to Lemon .S±reet.· In answer to Council questioning, Mr. Dave Collins reported that he had sold subject property to Mr. Johnson, retaining an easement on the south 20-feet for ingress and egress to the property which he owns fronting on Ball Road, and it was his intention to develop the easement at a ~uture date. Mr, Collins came forward to the Council Table, and with the aid of a sketch of the area, noted his ownership and locations of ~he easements which, when improved, would ultimately provide a private driveway from Anaheim Boulevard to Lemon Street~ an existing condition, which in his~opinion, was not a part of the zoning action before the City Council. ~, Geis!e~ advised that in :onnect!on with a zon!ng:'a~t!on, Council, ~f it is d~termined ~e ~ fer ~he saf~din~ ~nd be~ interest of the public, ~ Mayor Chandler reported that basically no one had a right to use a private easement except those permitted hy the property owners themselves. Mr. Geisler further advised that the existing rights are such that commercial traffic can go through the private easement at this time~ this being a change of commercial zoning from C-1 to C-3. Mrs. Florence Hill, 1137 South Lemon Street, reported that at the present time people living in the apartment development noMth of the Collins property located at the northeast corner of Ball Road and Lemon Street, cut through the vacant lot. 8308 City Hall. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. RESOLUIION NO. 64R-956: Councilman Dutton offered Resolution No. 64R-956 ' for a~oPtion authorizing preparation of necessary ordinance changing the zone as requested, subject to the recommendations of the City Planning Commission. RECLASSIFICATION 62~63r2~, Communications received from Mr. Dick Hoskins and Ntt. Joe Davidson regarding Condition No. 4 of Resolution No. 63R-84, pertaining to maximum size of allowable sign, and requesting said restriction he eliminated, was submitted to the City Council together with reports from the City Engineer and Planning Department Development Review. The history of subject reclassification was reviewed, and Mr. Geisler reported that conditions were imposed because of the close proximity of a. residential neighborhood, and as a result of a public hearing hefor~ the City Council~ he thereupon recommended that any alteration or changes to the conditions be only after additional public hearing. " Mr. Joe Davidson addressed the Council preparatory to presenting a picture of the sign they wish to erect. It was determined that such evidence should be withheld to be submitted when the matter is before the City Council at a public hearing. Councilman Krein moved that this matter be set for public hearing before the City Council on condition that the applicant pay the cost of $50. Councilman Dutton seconded the motion. MOTION CARRIED.' On motion by Councilman Dutton, seconded by Councilman Schutte, plans marked Exhibit No. 1 and 2, Revision No. 1, were approved. It was the general feeling of the City Council that appointments' should be made by the City Council and ratified by the School Board, and that neither members of the City Council or School Board be appointed to the commission.
