Minutes-ZA 1987/05/21F ~ r ~c AGENDA REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR THURSDAY, MAY 21, 1987, 9:30 A.M. PRESENT: Procedure to Expedite Meeting: The proponents for conditional use permit and variance applications which are not contested will have 5 minutes to present their evidence. In contested applications, the proponents and opponent will each have 10 minutes to present their case unless additional time is requested and the complexity of the matter warrants. After the opponent(s) speak, the proponent will have 5 minutes for rebuttal. Before speaking, please give your name and address and spell your last name. Staff Reports are part of the evidence received by the Zoning Administrator at each hearing. Copies are available to the public prior to and at the meeting. The Zoning Administrator may withhold questions until the public hearing is closed. The Zoning Administrator reserves the right to deviate from'. the foregoing if, in the Administrator's opinion, the ends of fairness to all concerned will be served. All documents presented to the Zoning Administrator for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary evidence, shall be retained by the City of Anaheim for the public record and shall be available for public inspection. The action taken by the Zoning Administrator on this date regarding conditional use permits and variances is final unless, within 15 days, an appeal is filed. Such appeal shall be made in written form'to the City Clerk, accompanied by an appeal fee equal to one-half the amount of the original filing fee. The City Clerk, upon filing of such an appeal, will set said conditional use permit or variance for public hearing before the City Council at the earliest possible date. You will be notified by the City Clerk of said hearing. After the scheduled public hearings, members of the public will be allowed to speak on items of interest under "Items of Public Interest". Such items must be within the jurisdiction of the Zoning Administrator. Each speaker will be allotted a maximum of 3 minutes to speak. OiVNER: ELIO C. FALCONE AND KATHLEEN'B. FALCONE, 142 Avenida Palmera, Anaheim, CA 92807. AGENT: NOONAN CONSTRUCTION, 510 E. Lincoln, Orange,- CA 92665. Subject property is a rectangularly-shaped parcel of land consisting of approximately 5000 square feet, having a frontage of approximately 50 feet on the east•side of Avenida Palmera, approximately 50 feet south of the centerline of Paseo Rio Azul and further described as 142 Avenida Palmera. Request for waiver of maximum lot coverage to construct a room addition to a single-family residence. `~ • No one indicated their presence at the public hearing•in.opposition and no correspondence was received in opposition to subject request. Although the staff report was not read at the public hearing, it is referred to and made• a part of the minutes. Gene Noonan, agent, was present. Annika Santalahti explained the requested waiver amounts to 40.30 lot,.coverage and the Code allows 350; and that 12 other similar waivers have been granted in the area, as listed in the staff report, paragraph 8; and that this is a fairly minor request ..and any effect would be minimal,. except to one neighbor. She asked if the owner had spoken with the neighbors.' Mr. Noonan explained the owner had, talked with neighbors, and they did not have a problem with the request. Ms. Santalahti pointed out the neighbors were all notified of-this hearing. She stated she would approve the request_on the basis that it is minimal at only 5.3o above Code and the precedent has been set with similar requests having been granted in the same zone and vicinity and on similar sized properties. No .one indicated their presence in opposition at the public hearing and no ocrrespondence was received in opposition to subject request. Although the staff report was not read at the public hearing, it is referred to and made a part of the minutes. Ralph Young, agent, was present and explained over 1/2 the houses in this area ,.and the houses immediately to the north and east have similar sideyard setbacks.. The public hearing was closed. Annika Santalahti explained the request~is for a 5:3 foot sideyard setback and Code requires 8.4 feet.. She stated she reviewed the aerial photograph of that area and noted a number of lots along~::Westwood appear to have similar setbacks and the staff report indicates five similar variances have been granted (Paragraph No. 8~, over the last 10 years. Ms .. Santalahti stated she would approve-this request ;on the basis that the precedent has been set with five similar variances having been granted in .'the same zone 'and vicinity and there are similar setbacks existing in the neighborhood. It was noted the applicant was not present. • • MINUTES, ZONING ADMINISTRATOR, May;-~21, 1987 - Page 3 Item No. 3 - continued Annika Santalahti stated she was interested in hearing from:the applicant because this is a request for two stories into the rear year within 10 feet of the property line and would like to know if the applicant has discussed the plans with the neighbors. • She stated she would continue consideration of this matter to the next meeting on June 4, 1987, in order for .the .applicant to be present and asked staff•to contact the applicant and request that he be present and that she would .like to know if he has contacted the neighbors.
