F~~ ~` t.~ ~ • ACTION AGENDA REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR THURSDAY, FEBRUARY 25, 1988, 9:30 A.M. - ~ Procedure to Expedite Meeting: The proponents for conditional use permit and variance applications which are not contested will have 5 minutes to present their evidence. In contested applications, the proponents and opponent will each have 10 minutes to present their case unless additional time is requested and the complexity of the matter warrants. After the opponent(s) speak, the proponent will have 5 minutes for rebuttal. Before speaking, please give your name and address and spell your name. Staff Reports are part of the evidence received by the Zoning Administrator at each hearing. Copies are available to the public prior to and at the meeting. The Zoning Administrator reserves the right to deviate from the foregoing if, in the Administrator's opinion, the ends of fairness to all concerned will be served. All documents presented to the Zoning Administrator for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary evidence, shall be retained by the City of Anaheim for the public record and shall be available for public inspection. The action taken by the Zoning Administrator on this date regarding conditional use permits and variances is final unless, within 15 days of the Zoning Administrator's written decision being placed in the U.S. Mail, an appeal is filed. Such appeal shall be made at any time following the public hearing and prior to the conclusion of the appeal period. An appeal shall be made in written form to the City Clerk, accompanied by an appeal fee equal to one-half the amount of the original filing fee. The City Clerk, upon filing of such an appeal, will set said conditional use permit or variance for public hearing before the City Council at the earliest possible date. You will be notified by the City Clerk of said hearing. After the scheduled public hearings, members of the public will be allowed to speak on items of interest under "Items of Public Interest". Such items must be within the jurisdiction of the Zoning Administrator. Each speaker will be allotted a maximum of 3 minutes to speak. None None 2/25/88 ~- `~~. • • REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR MINUTES - FEBRUARY 25, 1988 The regular meeting of the Anaheim City Zoning Administrator was called to .order by Annika Santalahti, Zoning Administrator, at 9:35 a.m., February 25, 1988, in the Council Chamber. PRESENT: Annika M. Santalahti, Zoning Administrator Lori Duca, Assistant Planner Della Files, Assistant Planner Ms. Santalahti noted there were two public hearings on the agenda, but the second item had been continued for two weeks in order to be readvertised. She said the public notice was in error stating the height to be 30 1/2 feet instead of 36 1/2 feet. Applicant was not present; however, two people indicated their presence in opposition. Mr. Whitman, 6945 E. Overlook, Anaheim,. CA 92807, an adjacent property owner, summarized his reasons for opposing this request and upon questions by Ms. Santalahti, said he would be present at the next hearing to repeat his concerns. ITEM N0. 1. LARGE FAMILY DAY CARE N0. 88-01 PUBLIC HEARINGS. APPLICANT: SUSAN M. CURFMAN, 7400 E.'Woodsboro, Anaheim, CA 92807. Subject property is a rectangularly-shaped parcel of land consisting of approximately 0.14 acre located at the southeast corner of Huxford Lane and Woodsboro Avenue, having a frontage of approximately 50 feet on the south side of Woodsboro Avenue and a frontage of 120 feet on the northeast side of Huxford Lane and further described as 7400 Woodsboro Avenue. Petitioner requests a Large Family Day Care home for a maximum of 12 children under authority of State Government Code Section 1597.46 of the Health and Safety Code and Chapter 18.10 of the Anaheim,Municipal Code. There were two people indicating their presence in support of the proposal and one letter in opposition and although the staff report was not read, it is referred to and made a part of the minutes. Ms. Santalahti said that day care centers for up to 12 children, under State law, are allowed a nondiscretionary permit. She said this permit can only be denied if there is an untruth in the application. Ms. Curfman, gave an overview of her facility and her educational qualifications. She gave Ms. Santalahti a packet containing additional • • MINUTES, ZONING ADMINISTRATOR, FEBRUARY 25, 1988 Page 2 information including five letters in support of her proposal which will be added to the one already in the file. Applicant explained why she felt the protest with respect to the traffic situation was not valid. She said she has a corner lot with access from the side.' She noted there is a lot of street parking because of it being a corner lot. She read the high points from the letters of support. In response to questions by Ms. Santalahti, applicant verified she had four off-street parking spaces, two in her garage and two on her driveway. She noted per the State license the ages of children allowed were from birth to five years old. Ms. Curfman said her children ranged in age from 14 months to three-plus years. She said the State reguired.a ratio of one teacher per six children. Ms. Curfman indicated she had one assistant (two employees including herself). She stated she already has a State license for 12 children. Jeff Azling, 266 Jutewood, Anaheim, said he has a daughter attending the day care center. He noted she has been attending for sometime and has grown quite attached to Ms. Curfman. Jerome Hall, 5227 Tango, Anaheim, said his grandson attends this facility. He felt it was well run and that it would be an emotional strain for his grandson to be moved to a different center. There was no one indicating their presence in opposition. PUBLIC HEARING WAS CLOSED: Ms. Santalahti noted that a day care center with six or less children is allowed by right, but that seven to twelve required a nondiscretionary permit. Ms. Santalahti asked what time children would typically be arriving and leaving the facility. Ms. Curfman said 7:10 a.m. would probably-be the earliest with most arriving between 7:15 a.m. and 8:45 a.m~.; however, a few would arrive around 9:30 a.m. She said some children would be leaving at 12:30 p.m. to attend preschool, some between 4:15 p.m. and 4:30 p.m., and some around 6:00 p.m. Ms. Santalahti approved this application noting the City's criteria for this use had been met (Ms. Santalahti read the criteria from a copy in the file), and that there appeared to be no false information on the application. Ms. Santalahti explained this decision becomes final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within 22-days of the date of the signing of this decision or unless a member of the City Council shall request to review this decision within said 22-days. ..,~ • MINUTES, ZONING ADMINISTRATOR, FEBRUARY 25, 1988 Page 3 ITEM N0. 2.
