STAFF PRESENT: Annika Santalahti, Zoning Administrator Kevin Bass, Associate Planner Patricia Koral, Word Processing Selma Mann, City Attorney .Roger Bennion, Senior Code Enforcement Officer 11. REPORTS AND RECOMMENDATIONS: A. APPROVED SPECIAL EVENT AT THE ARROWHEAD POND OF ANAHEIM, :Applicant, JIM LYNSKEY, 2695 East Katella Avenue, Anaheim, CA 92806 requests to permit athree-day Jet watercraft competition with accessory outdoor activities. Property 1s located at 2695 East Katella Avenue. REMARKS: Kevin Bass, Assoclate Planner, stated that the Water Engineering Department has asked that an agreement be put together to assure that the water be treated and recycled. Annika Santalahti the Zoning Administrator concurred with Staff that this request, including the CEQA Categorical Exemption, be approved to permit the proposed three-day outdoor personal watercraft competition event with accessory activities (Including outdoor concerts) on (August 15, 16 and 17) based on the fallowing: 1. The Arrowhead Pond of Anaheim has been identified as a location suitable for large-venue events, and the PR(FP) Zone permits special event activities, including outdoor activities such as outdoor concerts, and other exhibitions and displays. 2. The City Traffic and Transportation Manager has reviewed the proposed event, and determined that the area can support the increased traffic and parking. 3. The Anaheim Public Utilities Department has reviewed and approved an agreement with the applicant for providing water for the event, and that the water shall be recycled at the applicant's expense. FURNITURE STORE: Applicant, DANIEL ROSENBERG, 333 South Euclid Street, Anaheim, CA 92802 requests to permit outdoor displays, flags, and banners for 90 days. Property is located at 333 South Euclid Street. REMARKS: Mr. Helmuth Thompson, representing Daniel's Furniture was present. DENIED Roger Bennion, Code Enforcement Division, reviewed a memo showing a history of Code violations regarding unpermitted special events (Including outdoor displays, temporary advertising, etc.) at this property. On June 11, 1997, a field investigation fdentrfied several unpermitted temporary advertising devises (flags), shipping boxes and debris from packaged items in the parking lot adjacent to Euclid Street, and excessive temporary window signage covering more than the Code-permitted 20% of the window area at this property. The Zoning Administrator concurred with the staff report recommendailon and the testimony submitted during the meeting and dented Special Circumstances Waiver No. 97-04 based on the following: (a) That the Code Enforcement Division has issued numerous citations pertaining to unpermitted temporary advertising and outdoor displays wfthout the necessary Special Event Permit, and that granting this waiver would not serve the public interest in any manner. (b) That no special or extraordinary circumstances were identified by the petitioner or staff to justify the request for additional outdoor displays and temporary advertising. (c) That a 90 day special event is significantly more that permitted by Code (36 days annually). The Zoning Administrator noted that, based on the complaint history regarding this business, there has cleady been an interest shown by the nearby property owners/businesses regarding the business (Daniel's Furniture) and, if the applicant wished to pursue outdoor display, it would be appropriate that he file a petftion so the request could be considered at a public hearing. 06/19/97 Page 2 PUBLIC HEARING ITEMS: 2a. CEOA NEGATIVE DECLARATION 2b. WAIVER OF CODE REQUIREMENT 2c. CONDITIONAL USE PERMIT NO. 3946 OWNER: WEIR CANYON CORPORATE CENTER, LLC 160 South Old Springs Road Anaheim, CA 92808 AGENT: DONALD LAM 160 South Old Springs Road Anaheim, CA 92808 APPROVED/with new condition added. LOCATION: 160 South Old Sorfngs Road. Property is approximately 4.15 acres located ai the southeast corner of Kaiser Boulevard and Old Springs Road and further described as 160 South Old Springs Road. To permit a 9,398 square-foot preschool with waiver of minimum number of parking spaces. ZONING ADMINISTRATOR DECISION NO . 97-10 REMARKS: Rex Blanchard, representing the applicant, was present. OPPOSITION: No one indicated their presence. Selma Mann, City Attorney stated that this item has a waiver of minimum number of parking spaces and that if ft is granted there is a condition that is typically added that includes language from the code specifying that the waiver is granted contingent upon the described business operation and conformance with the assumptions that were in the parking demand study that formed basis for the waiver. Kevin Bass, Associate Planner agreed that there is such a standard condition that should be included if this is approved; and that the parking study is a letter dated May 14, 1997 and approved by Traffic Engineering and that staff recommends approval of this item with the additional condition to read 'That the granting of the parking waiver is contingent upon operation of the use in conformance with the assumptions relating to the operation and intensity of use as contained in the parking demand study that formed the basis for approval of said waiver. Exceeding, violating, intensifying or otherwise deviating from any of said assumptions, as contained in the parking demand study, shall be deemed a violation of the expressed conditions .imposed upon said waiver which shall subject this Conditional Use Permit No. 3946 to termination or modification pursuant to the provisions of Sections 18.03.091 and 18.03.092 of the Anaheim Municipal Code." The Zoning Administrator approved the negative declaration and approved Conditional Use 06/19/97 Page 3 Permit No. 3946 with Inclusion of the additional condition as described by staff. 3a. CEOA CATEGORICAL EXEMPTION-CLASS 5 3b. ADMINISTRATIVE ADJUSTMENT NO. 120 OWNER: MANZANITA WALK, LLC 3010 Old Ranch Parkway, #400 Seal Beach, CA 90740-2750 AGENT: MICHAEL HENNESSEY 3010 Oid Ranch Parkway, #400 Seal Beach, CA 90740-2750 NO ACTION TAKEN LOCATION: 608 West Vermont Avenue. Property is approximately 2.78 acres located on the south side of Vermont Avenue and approximately 190 feet east of the centedine of Citron Street. To construct an eight-foot high fence along the east, west and south property lines to screen a previously approved 48-unit °affordable" condominium complex. ZONING ADMINISTRATOR DECISION NO. Appeal period ends June 18, 1997 at 5:00 p.m. NO ACTION TAKEN REMARKS: Kevin Bass, Associate Planner, stated that staff receved a letter of opposition during the notification period and, therefore, this administrative adjustment (waiver) cannot be approved without a public hearing, and that the applicant would be notified so he could decide whether he wanted a public hearing or wished to withdraw this request. OPPOSITION: A letter of opposition, dated June 16, 1997, is on file. Applicant has received a copy of letter and has been notified this would necessitate a public hearing in order to have a discussion on the wall and .lattice fence. 4.
