Property is approximately 0.34 acre having a frontage of 144 feet on the east side of State College Blvd., located approximately 168 feet south of the centerline of Westport Drive. To permit the sales of beer and wine for on-premises consumption in conjunction with an existing 2,235 square foot enclosed restaurant. ZONING ADMINISTRATOR DECISION NO. 96_28 9:40 A.M. The applicant not being present, and staff having attempted to reach the applicant by phone and being unable to do so, the Zoning Administrator continued this request to the next meeting of October 23, 1998 and adjourned the meeting. 9:47 A.M. The applicant entered the Council Chambers and the Zoning Administrator re-convened the meeting, recinded the continuance, and re-opened the public hearing. Christopher Sarkissian, took time and reviewed conditions of the staff report at the Administrative hearing and was satisfied with the conditions. The Zoning Administrator approved Conditional Use Pennit No. 4063 subject to the conditions as recommended by staff with acceptions of A one year limitation for conditional use permit at a new location.. Standard conditions typically use the phrase alcoholic beverages, and this is a beer and wine specifically and if approved the wording alcohol and beverages will be changed. Condition No. 5 references that there shall be no more than 40 seats both in and out of doors to insert the word "at these premises". Insert a new condition no. 23 indicating that they shall obtain an Alcbholic Beverage Control License for beer and wine. That condition no. 20 is modified to read that condition 16, 17, 18, 19 and 23 shall be met prior to commencing the operation that has been approved. This proposal is for beer and wine for on premises consumption in connection with the service of meals at all times and it is just a table set up. In connection with a permit like this, if the City approves it, the applicant must obtain a license from the State of California Alcoholic Beverage Control Board which may or may not approve it, so the approval made at this hearing would not be the final decision. The Zoning Administrator requested that a copy of the decision and staff report be sent to the school district. The Sarkissian's sent a letter (attached to the staff report) to the school district regarding previous concerns that the school district had but neither the Sarkissian Family or the City received acknowledgment or response. t oiosi9a ~~"GE A palm tree was cut and the Zoning Administrator requested a replacement with trees and the applicant agreed. PLANNER: Dave See, stated that we did not receive a letter from the school district similar to the one we received last year for a similar case.
