To establish a 4-lot (3 numbered lots, 1 lettered lot} single-family residential subdivision in the RS-HS-22,000 (SC)(Residential, Single- Family HiNside; Scenic Corridor Overlay) Zone for the future construction of 3 single family homes. ZONING ADMINISTRATOR DECISION NO. 2000-14 TW Continued from the February 24, 2000 Zoning Administrator meeting Mr. Thoai Tang presented the Zoning Administrator with a letter showing that the undersigned names have agreed to certain terms and conditions regarding the road known as Autry Drive. It states that all households that use Autry Drive as an access to and from their property will share in the responsibility to maintain the road property. All necessary construction must be approved by all households prior to the actual work. All expenses for the maintenance and construction work must be approved by all households prior to actual work. And lastly, all households will carry an equal and fair financial burden for all maintenance and construction work. This letter was signed by Tang family, Stowers family and the Yun family. ZA032300.doc Page 1 • • Tom Tonelli was not clear on Condition No. 13 regarding an unsubordinated maintenance covenant. He was under the impression that this conversant agreement was to go into effect upon approval of this tentative parcel map and on was that opposed basis. Selma Mann, Deputy City Attorney informed Mr. Tonelli that Condition No. 13 was to apply in the event that the neighbors put together a maintenance agreement. In which case, the owners of subject parcels would also be participants, but that a maintenance agreement would not be a requirement as a result of the approval of this tentative parcel map. Annika Santalahti, Zoning Administrator approved Tentative Parcel Map No. 98-242 fora 4-lot subdivision located on Autry Drive, subject to the conditions in the staff report and Ms. Mann's added sentence to Condition No. 13. 2.
