Judy Dadant, Senior Planner, introduced Item No. 1 and stated that at the printing of staff report dated August 17, 2006, staff had not received any letters of opposition, however at the time of this meeting a letter of opposition had been submitted to the case planner. She explained that if staff had not received any letters of opposition within 10 days of the notice of the present Zoning Administrator hearing, the application would have been automatically approved. However, since staff received a letter of opposition it was up to the applicant to decide whether the item would be set for public hearing or whether he wished to accept the denial and not continue with the request. Judy Dadant, Senior Planner, introduced Item No. 2. THE PUBLIC HEARING WAS OPENED. No one wished to speak and no opposition was received regarding this item. THE PUBLIC HEARING WAS CLOSED. Mrs. Dadant presented further discussion regarding plans and procedures to follow in processing the Special Circumstances Waiver. Mr. Sell concurred with staff's recommendations based upon the evidence submitted, including the evidence presented in the staff report dated August 17, 2006, and oral and written evidence presented at the meeting, and approved (a) CEQA Categorical Exemption, Class 11 (Accessory Structures} and (b} Special Circumstances Waiver No. 2006-00034 as follows, with modifications: That the duration of the Special Event Permit shall be subject to the time limitations contained in Section 18.44.190.060 of Section 18.44.190, Temporary Tract Signs. 2. That the banners shall be kept clean, neatly maintained, with no missing sign copy, or ripped or faded material. Any un-maintained or damaged portion of the banners shall be repaired or replaced immediately. Noncompliance shall constitute a public nuisance and shall be subject to termination of this permit. 3. Judy Dadant, Senior Planner, introduced Item No. 3. THE PUBLIC HEARING WAS OPENED. Applicant's Testimony: Mark A. Ulves, 343 Royal Ridge Drive, Anaheim, CA, stated they have an existing outdoor deck off the side of their kitchen which was originally built with the home so they are proposing to enclose it within the bounds of the existing structural line. This would prevent drainage falling onto the deck from causing wood rot and it would also assist in enlarging their kitchen. Mr. Sell asked the proximity of the neighbor's house next door. Mr. Ulves responded approximately 10 feet. He presented plans showing a line of Italian Cypresses separating his home from his neighbor's that extended to the end of the property line which would prevent viewing from either side of the line. Mr. Sell further inquired regarding window placement and the entrance to the room. Mr. Ulves responded currently he has slider doors but he planned to replace them with windows. He discussed trying to find a way to exit from the patio to the exterior staircase but he did not want the architect to spend a lot of time and money to do that so he may not go forward with that idea.
