Judy Dadant, Senior Planner, introduced Item No. 1 and stated that at the printing of staff report dated August 31, 2006, staff had not received any opposition to the request. THE PUBLIC HEARING WAS OPENED. Applicant's Testimony: Brad Smith, Architect, 365 # B Old Newport Boulevard, Newport Beach, CA, stated the site plan and philosophy that generated the project was that they wanted to have less paved area in the public setback. In order to reduce the paved area they determined that they could turn the garage doors 90 degrees rather than front onto the street which is presently the case. Their intent is to take the existing rear yard configuration and match it so that they will not provide any additional impact to homes on the westerly side and also maintain the setback in the rear and not impact anyone's view or privacy from the southerly side. PUBLIC Testimony: Phil JouJon Roche, President of SACPOA (Santa Ana Canyon Property Owner's Association), asked how many garages he would have. Mr. Smith responded they have 5 car parking enclosed. Presently, there are 3 cars but when passing through the neighborhood many cars may be visible in the driveway however, their intent is to house them all. Page 2 ACZA083106. No one else wished to speak and no opposition was received regarding this item. THE PUBLIC HEARING WAS CLOSED. Ms. Ridge concurred with staff's recommendations and approved Administrative Adjustment No. 2006- 00289 and stated the decision would be written and signed no later than 7 days from the date of the meeting and the decision would be final after the appeal period expires 15 days following the date of the decision. To amend the existing conditional use permit to permit the sale of alcoholic beverages for on-premises consumption and amend conditions of approval pertaining to hours of operation in conjunction with an existing restaurant. Judy Dadant, Senior Planner, introduced Item No. 3 and stated staff finds that there are special circumstances relating to the property that would justify the waiver of code requirement, specifically the property is located on a piece of property that is on a bend of Manchester Avenue. The code allows for adjacent walls to have signage for properties on corner lots and although it is not technically a corner lot it has the perception of a corner lot. In addition, because of the unique design of the building structures such as the staggered building walls, the appearance is not like adjacent walls because of the separation. The walls are not quite adjacent for standard interpretation of that definition, and because of the way the building is designed, with railings and entrances to the hotel rooms, there are no other alternatives for the placement of the signs from a practical standpoint. Also, the other building is located significantly far from the right-away and would preclude visibility of the signs. THE PUBLIC HEARING WAS OPENED. Applicant's Testimony: Praful Patel, 1441 S. Manchester Avenue, Anaheim, CA, stated even if there was a request to put in signs as required by code, he could not because all the other areas are walkways used by guests and also the property is set so far back, almost hidden away, that you could not see it if the signs were placed there. Ms. Ridge concurred with staff's recommendations based upon the evidence submitted, including the evidence presented in the staff report dated August 31, 2006, and oral and written evidence presented at the meeting, and approved (a) CEQA Categorical Exemption, Class 11 (Accessory Structures) and (b) Variance No. 2006-04691 (to permit and retain two existing wall signs on adjacent elevations of an existing hotel) by adopting the attached resolution including the findings and conditions contained therein. 4.
