Applicant's Testimony: Susan Snell, 1051 South Pine Canyon Circle, Anaheim, CA, stated the deck, after replacement, will be a lot smaller than what it currently is and also less encroachment than when they bought the house in 1984. She feels the podocarpuses planted along the back of the property will be the answer to privacy issues, once matured, and also the deck would be setback 10 feet from its current position. Mr. See stated staff received two letters from the residents in the rear of the subject property and they were concerned about privacy should a balcony be built within 12 feet of the property line. They wrote in their emails that they would not be opposed if there were trees or some type of screening to protect their privacy. Staff spoke with the applicant and they agreed to work with staff on the tree type or keep the podocarpuses, which would provide screening once grown to maturity. Page 3 ACZA011906. DOC • JANUARY 19, 2006 ZONING ADMINISTRATOR ACTION AGENDA Mrs. Snell stated also the patio enclosure would be a day office, not a bedroom, etc., and there would be a desk in front of it and people would not stand on the edge thereby creating less encroachment than it currently is. Mr. Sell stated one of the issues from a neighbor's standpoint might be to make sure there is some documentation in the records that requires the screen to continue to be there so that long term it isn't changed and someone all of a sudden is looking down someone's backyard. Mr. Sell asked if anyone else wished to comment on Item No. 2. No one else indicated their presence at the meeting regarding this item. Mrs. Snell submitted additional photos. John Ramirez, Associate Planner, introduced the item. He stated approximately two years ago, when the original tentative parcel map was approved by the Zoning Administrator, it was staff's understanding that the sewer study would be completed and conducted by the City within the following 4 to 6 months. Given the constraints of the property owner in terms of financial resources to conduct a similar study on his own, staff consulted with the City Attorney's Office and Public Works Department and agreed that as a practical solution and given the consideration of time and money invested by both the property owners that the most appropriate thing to do would be to delete the condition of approval and allow the map to be filed and recorded as originally planned.
