David See, Senior Planner, introduced Item No. 2. THE PUBLIC HEARING WAS OPENED. Ilona Nanda, Coorg Corporation, P.O. Box 1266, Anaheim, CA stated she was present to answer questions. No one else wished to speak and no opposition was received regarding this item. Mr. Sell asked if the requested sign was attached to an existing wall and if actions were in place to prohibit graffiti. Mr. See responded yes, the requested sign was attached to an existing wall on the west property line adjacent to an industrial use and the opposite side was also an industrial property and not visible from the public right-of-way. THE PUBLIC HEARING WAS CLOSED. Mr. Sell concurred with staff's recommendations and approved Administrative Adjustment No. 2006- 00300 for waiver to permit and retain an existing 9.5 foot high masonry wall for an existing self storage facility under authority of Code Section No. 18.62.040.020.0203 (maximum wall height; 8 feet permitted; 9 feet, 6 inches high proposed) by adopting the attached resolution including the findings and conditions contained therein. He stated the decision would be written and signed no later than 7 days from the date of the meeting and would be final after the appeal period expires 15 days following the date of the decision. David See, Senior Planner, introduced Item No. 3, stating staff recommended denial of waiver (a) because it had been deleted and recommended approval of waiver (b) maximum letter height to construct new wall signs for an existing commercial retail center. He stated it is a large commercial retail center with a lot of depth and not much visibility from the street compared to other commercial centers in the area for long deep'commercial retail properties. THE PUBLIC HEARING WAS OPENED. Phillip Schwartze, 31682 EI Camino Real, San Juan Capistrano, CA, representing Metro Properties, LLC, stated they read and concur with the staff report. He stated Metro Properties bought the old center in west Anaheim and invested a large sum of money into it in order to attract national tenants as opposed to local mom and pop tenants, and in doing so they observed the signs in the surrounding commercial centers and developed a sign program that not only upgraded the area but also contrasted with national logos for easy observation by people visiting the center. He concluded they feel the waiver is appropriate since comparable shopping centers in the area have great economic advantage with their signs but in comparison the applicant's property, having several hundred feet in depth, is treated as if it were a strip center faced against Lincoln Avenue where one would have the opportunity to look at it at a very close range as opposed to a great distance. He illustrated a sign program that accompanies each building with various breakdowns so that the sign would be in proportion to the total square footage being requested by the individual. Page 4 ACZA122106. DOC C • DECEMBER 21, 2006 ZONING ADMINISTRATOR ACTION AGENDA No one else wished to speak and no opposition was received regarding this item. THE PUBLIC HEARING WAS CLOSED. Mr. See clarified that the major tenants would have 48 inch letter height which is proportional to the size of business and the smaller tenants would have 24 inch letter height which complies with code. Mr. Sell asked if that is the way the recommendation should be or if it limited the 48 inch letter height to the major tenants. Mr. See responded that it is conditioned based on the exhibits. Mr. Sell stated that his concern is that a liberal interpretation that stated some would have 2 feet and others 4 feet would not present a consistent look for the entire project therefore, he asked that a condition be created that would show the intent is to have 4 feet for the major tenants and 2 feet for the smaller tenants. Mr. See responded that staff would draft a new condition which would indicate that major tenants 10,000 square feet or larger would have 48 inch letter height and the remainder would have to comply with code. Mr. Sell concurred with staff's recommendations based upon the evidence submitted, including the evidence presented in the staff report dated December 21, 2006, and oral and written evidence presented at the meeting, and concurred with staff regarding (a) CEOA Categorical Exemption, Class 11 (Accessory Structures) and approved Variance No. 2006-04712; deleting waiver (a) permitted type of sign, and approving waiver (b) maximum letter height to construct new wall signs for an existing commercial retail center. Anew condition was added to the conditions as follows: 6. That forty-eight (48) inch high signs shall be permitted for all tenant spaces with a minimum floor area of 10,000 square feet. All tenant spaces with a floor area of less than 10,000 square feet shall comply with Zoning Code requirements pertaining to wall signage. Page 5 ACZA122106. DOC
