ZA2007-08 Project Planner: (ethien@anaheim.net) SrVAR2007-04732eyt.doc William Sell, Zoning Administrator, opened the public hearing. Elaine Thienprasiddhi, Associate Planner, introduced Item No. 2. Applicant's Testimony: Phillip Schwartze, agent for the applicant, 31872 San Juan Creek Circle, San Juan Capistrano, CA, stated recently they had a conditional use permit approved to reutilize the subject office building for a private university located in the Resort area. He stated the building has been in place for several years and they recently spent several million dollars refurbishing it and getting it approved for the university however, there is an odd situation in that the freeway has been widened in front of the property which resulted in the right-of-way coming so close to the building that if you were going either direction on Manchester Avenue it would be impossible to see a sign at the top of the building. Currently the Resort area sign code only allows one sign on the property; therefore, they respectively ask for two signs on the property for easy identification to the property location. The future plan is to have afternoon and evening classes for nurses. There is a turnover every three (3} to four (4) months of approximately 400 to 500 new Page 2 ACZA081607. DOC • AUGUST 16, 2007 ZONING ADMINISTRATOR ACTION AGENDA visitors on the property; therefore, they feel it is very important for security purposes and easy access to have the sign on both the north and south sides of the building. He stated that two representatives from the sign company were also present to answer technical questions regarding the structure and electrical questions. The two representatives are as follows: Mark Watkins, Young Electric Sign Company, 1443 South Cucamonga Avenue, Ontario, CA and Doug Arch, Carey Signs, 2871 Blue Star Street, Anaheim, CA. Mr. Sell wished to clarify, because of the way the frontage is structured, if they planned to have monument signs. Mr. Schwartze responded the monument signs in the front were originally permitted under an earlier conditional use permit but the new right-of-way shoved everything over causing the signs to encroach into the City right-of-way, and as a part of the approval for the university they were required to terminate the original approval of the monument signs. Therefore, they felt their current proposal would more appropriately assist prospective visitors to quickly locate their building traveling north or south as opposed to driving along the freeway and trying to locate a small sign. Mr. Sell asked if they were requesting 24 inch lettering. Ms. Thienprasiddhi responded 36 inch lettering, and that 24 inch lettering is actually the space in between the edge of the lettering to the edge of the parapet. She stated the lettering conforms to the Anaheim Resort Code for a building of that height. Mr. Sell asked if the additional logo would be included as a part of the sign. Ms. Thienprasiddhi responded the Anaheim Resort Code allows logos up to 4 feet in height and staff made a determination that the small points extending from the logo would not count as exceeding that height limitation since the bulk of the logo is limited to the height of the channel lettering. Mr. Sell wished to clarify if they would be putting a 3 foot sign on a 70 inch facade. Ms. Thienprasiddhi responded the dimensions show from point to point. She asked the applicant if they new the dimensions of the parapet. Mr. Schwartze responded the total parapet is approximately 9 feet. Mr. Sell asked if the color scheme is consistent with the permitted Anaheim Resort Code. Ms. Thienprasiddhi responded yes. Mr. Sell asked if the letters were being illuminated. Mr. Schartwze responded yes. Mr. Sell asked if that is consistent with the Anaheim Resort plan as well. Ms. Thienprasiddhi responded yes. Mr. Sell stated he is concerned with the replacement of bulbs should one burn out and he asked if there is a requirement for maintenance in the Anaheim Resort code. Ms. Thienprasiddhi responded no, not specifically in the Anaheim Resort code but the sign code contains provisions pertaining to maintenance of signs. Should a bulb burns out replacement should always occur as general practice. Page 3 ACZA081607.DOC AUGUST 16, 2007 ZONING ADMINISTRATOR ACTION AGENDA Mr. Schwartze stated they would be happy to accept a condition that a burned out bulb would have to be replaced within 36 hours. Mr. Gordon stated under Chapter 6.44 the time that affects such a repair would be a little longer than that but if they are willing to accept that statue it could be included. Mr. Sell stated he is glad to see the building being refurbished and the signage is done in a modest way and is not overbearing, especially since the monument sign has been removed. He closed the public hearing and approved CEQA Categorical Exemption -Class 1 and Variance 2007-04732, denying the waiver pertaining to logo height, since it had been withdrawn and approving the waiver pertaining to maximum number of signs, including the additional condition that any need for repair would be addresses within 48 hours. He stated the decision would be written and signed no later than 7 days from the date of the meeting and would be final after the appeal period expires 15 days following the date of the decision.
