Request to construct a second story addition on an existing single-family residence with a side yard setback less than required by code. Resolution No ZA2008-21 Approved 15-day appeal period Project Planner. Scott Koehm SKoehm@anaheim.net John Van Doren, Zoning Administrator, opened the public hearing. Scott Koehm, Associate Planner, introduced Item No. 2 and noted that a varia~ce was granted for the subject property in 2001 to permit a 3 foot side yard setback when a 6 foot setback was required. The addition to the residence was never constructed and the variance expired. Due to the unique shape of the property, the surrounding topography and because of the distance between the proposed second story and the adjacent single-family residence; staff recommends approval of the subject request. Mr. Van Doren pointed out for clarification the only variance being reviewed at this time is for a side yard setback for a second story room addition where a portion of the building wall encroaches into the setback and the remainder of the wall is outside of the setback due to the wall not being parallel to the property line. Mr. Koehm responded yes. Hamid Zanjani, 419 South Windmill Lane, Anaheim, CA, stated he is the owner of the subject property and is asking for approval of the request. Mr. Van Doren asked staff for clarificatio~ pertaining to the photos he received with the material for the subject item; Ted White, Senior Pianner, responded that the subject property sits approximately 25 feet higher than the adjacent properiy to the west and fhat the photographs show the subject property and the adjacent lower property. Mr. Van Doren took action to approve the subject request, based on the findings described in the staff report and resolution prepared by staff. MEETING ADJOURPlED AT 9:40 A.M.
