Resolution-ZA 1988-19 • • DECISION OF THE ZONING ADMINISTRATOR - ZA 88-19 PETITION NO.: VARIANCE N0. 3769 CEQA STATUS: CATEGORICAL EXEMPTION - CLASS 5 AND 1 DATE. OF PUBLIC HEARING: April 7, 1988. OPPOSITION: No one indicated their presence in opposition, and no correspondence was received in opposition. OWNER: JACK E. RRUGER, 1019 N. Cambria Place, Anaheim, CA 92801 LOCATION: 1019 North Cambria Place .REQUEST: Petitioner requests waiver of the following to construct a 1-story, 982 square-foot addition to wn existing single-family residence. (A) SECTION 18.06.040.020 - Minimum Dimension of Parking Spaces. and 18.26.066.020 (10' X 20' garage spaces required; 9' X 20' existing and proposed) (B) SECTION 18.26.063.011 - Minimum "Front-on" Garage Setback. and 18.26.060.0111 (10 or 25 feet required, 20 feet proposed). Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and"a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the request is minimal with an average garage setback of 24 feet from the front property line and that the proposal extends the depth of the existing garage where each space is only 9 feet wide currently; 2. That there is a pending Code amendment which will permit the front-on garage setback, as proposed, and that the petitioner is proposing to install a roll-up garage door; 3. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 4. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity.. CALIFORNIA ENVIRONMENTAL OUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal to construct a 1-story, 9$2 square-foot addition to an existing single-family residence on an irregularly shaped parcel of land consisting of approximately 0.14 acre, having a frontage of approximately 75 feet on the west side of Cambria Place, having a maximum depth of approximately 100 feet and being located approximately 200 feet south of the centerline of La Palma Avenue, and further described as 1091 North Cambria Place; and the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 5 and 1, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. ~ `~_ Y Page 2 Variance No. 3769 Based on the evidence and testimony presented to me, I do hereby determine to _' approve Variance No. 3769, subject to the following conditions: 1. That prior to issuance of a'building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council. 2. That roll-up garage doors shall be provided for the front-on garage with less than a 25-foot setback. 3. That subject property shall be developed substantially in accordance with plans and, specifications on file with-the .City of Anaheim marked Exhibit Nos. 1 through 3. 4. That prior to issuance of a building permit, or within a period of one year from the date of this decision, whichever occurs first, Condition Nos. 1, 2 and 3 above-mentioned, .shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 ,of the Anaheim Municipal Code. 5. ..That prior to Final building and zoning inspections, Condition No. 4, above-mentioned, shall be complied with. 6. That: approval of this application constitutes approval of the proposed request only to .the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City regulations. Approval does not include any action or findings as to compliance or approval of 'the request regarding any other applicable ordinance, regulation or requirement.
