Resolution-ZA 1988-26 • r~ ~~ DECISION OF THE ZONING ADMINISTRATOR - ZA 88-26 PETITION NO.: VARIANCE N0. 3789 CEQA STATUS: NEGATIVE DECLARATION DATE OF PUBLIC HEARING: May 5, 1988 OPPOSITION: No one indicated their presence in opposition and no correspondence was received in opposition. OGDEN, JR., 4040 MacArthur Blvd. #314, Newport Beach, CA 92660 LOCATION: 1150 North Harbor Boulevard REQUEST: Petitioner requests waiver of the following under authority of Code Sections 18.06.080 and 18.12.060.110 to permit a Checkerboard Pizza Restaurant: SECTIONS 18.06.050.022 - Minimum number of parkins spaces. 18.06.050.0231 (107 required; 79 proposed) 18.06.050.0233 and 18.44.A66.050 Having been appointed Zoning Administrator by the .Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide-the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the proposal is a take-out restaurant which does not include any sit-down eating facilities; 2. That the City Traffic .Engineer approved the parking demand study which was prepared to substantiate the request;. 3. That the variance will not cause an increase in traffic congestion in the immendiate vicinity nor adversely affect any .adjoining land uses; and 4. That the granting of the variance under the conditions imposed will not be deterimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. CALIFORNIA .ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal to permit a fast food pizza restaurant (Checker. Board Pizza) on an irregularly-shaped parcel of land consisting of approximately 1.1 acres. located at the .southeast corner of Romneya Drive and Harbor Boulevard, having approximate frontages of 2.25 feet on the south side of Romneya Drive, 175 feet on the east side of Harbor Boulevard. and 250 feet on the northeast side of Anaheim Boulevard; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process-and further finding on ,the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. ,,r Page 2 Variance No. 3789 Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3789, subject to the following conditions: 1. That the proposal shall comply with all signing requirements of the CL Zone, unless a variance allowing sign waivers is approved by the City Council, Planning Commission or Zoning Administrator. 2. That the on-site restaurants shall be limited to the following floor areas and-that no additional restaurant square footage shall be permited unless a variance allowing an additional parking waiver is approved by the City Council, Planning Commission or Zoning Administrator: 1,000 sq.ft. of enclosed, sit-down restaurant, and 2,159 sq.ft. of fast food restaurant services. 3. That subject property shall be developed substantially. in accordance with ,plans. and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 3. 4. That prior to final building and zoning inspections, Condition No. 3, above-mentioned, shall be complied with. 5. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoninq Code and any other applicable City regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
