Batavia Street Orange, CA 92668 REQUEST: To construct a 392 square-foot addition to an existing Taco Bell restaurant with waiver of minimum side yard setback (5 feet required; 4 feet proposed) at 130 North State College. DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and having. been duly noticed and no written objections having been received, I do hereby-find, pursuant to Section 18.12.080: 1. That the requested waiver of Code Section Nos. 18.12.080.010 and 18..44.063.020 (minimum setback from Underhill Avenue in the "Commercial, Limited" Zone) consists of an addition to an existing building which structure is already setback 4 to 5 feet from the subject street, as shown on Exhibit Nos. 1 to 3 on`file with the City of Anaheim; 2. That no written opposition to the proposal was received during the public notice period; 3. That there are special circumstances applicable to the property such as size, shape, topography, location or surroundings, which do not apply ,to other. identically zoned properties in the vicinity; and 4. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal to construct a 392 square-foot addition to an existing Taco Bell with waiver of minimum side yard setback (5 feet required; 4 feet proposed) at 130 North .State College; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 5, as defined in .the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. ~ °~ " Administrative Adjustment No. 88-07 Page 2 Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 88-07, unconditionally.
