CA 92714 LOCATION: Property is approximately-11 acres located on the north side of La Palma Avenue between Hancock Street and Manaserro Street. REQUEST: Petitioner requests waiver of the following under authority of Code Sections 18.12.060.060 and .080 to establish a 4-parcel subdivision: SECTION 18.01.130 - Recruired Lot Frontage. (required: all parcels to have frontage on at least one public-street or alley; proposed: l parcel without frontage) Havinq been appointed Zoning Administrator. by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide. the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the proposal is minor in that public street frontage is not necessary for access because suitable vehicular and pedestrian access will be provided via a recorded 25-foot wide ingress- and egress easement from Hancock Street. 2. That there are special circumstances: applicable to the property such as size, shape,.. topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 3. That strict. application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical-zoning classification in the vicinity. ZA88-54 • • Page 2 Variance No. 3838 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of required lot frontage to establish a 4-parcel subdivision on a rectangularly-shaped parcel of land consisting of approximately 11 acres located at the northwest corner of La Palma Avenue and Manassero Street, and having approximate frontages of 809 feet of the north side of La Palma Avenue and 530 feet on the west side of Manassero Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3838, subject to the following conditions: 1. That unless proof of exemption is submitted prior to issuance of a building permit, showing compliance with City Council Resolution No. 85R-423, the appropriate major thoroughfare and bridge fee shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfare and Bridge Fee Program for the Foothill/Eastern .Transportation Corridor, in accordance with City Council Resolution No. 85R-423. 2. .That a reciprocal access and parking agreement, in a form satisfactory to the .City Attorney, shall be recorded with the Office of the Orange County Recorder. Said agreement may be recorded on the face of (or otherwise in conjunction with) subject parcel map. If the agreement is not recorded in conjunction with the parcel map, a copy of the recorded agreement shall be submitted to the Zoning Division. 3. That sidewalks shall be .installed along La Palma Avenue as required by the City Engineer. and in accordance with standard plans and specifications on file in the Office of the City Engineer. 4. That gates shall not be installed across any driveway in a manner which may adversely affect vehicular traffic in the adjacent public streets. Installation of any gates shall conform to the Engineering Division's Standard Plan No. .402 and shall be subject to the review and approval of the City Traffic Engineer. 5. That all driveways shall be constructed with ten (10) foot radius curb returns as required by the City Engineer. Existing broken or cracked .driveways shall be removed and replaced as required by the City Engineer. 0109g 2 ZA88-54 • • Page 3 Variance No. 3838 6. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 7. That a parcel map to record the division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 8. That prior to issuance of a building permit, the appropriate fees due for primary mains and fire protection service for the southwestern 3.1 acres (labeled Parcels 2, 3 and 4) of the subject property shall be paid to the Water Utility Division in accordance with Rules 15A and 20 of the Water Utility Rates, Rules and Regulations. 9. That in lieu of payment of traffic signal assessment fees, the owner/developer shall construct a traffic signal at the intersection of La Palma Avenue and Manassero Street; and that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City prior to issuance of the -first building permit to guarantee the installation of said signal to the satisfaction of the City Traffic Engineer. Said security shall be posted with the City to guarantee traffic signal installation prior to January 1, 1991. 10. That subject proposal authorized by this resolution shall be served by underground utilities. 11. That prior to commencement of structural framing, fire hydrants shall be installed and charged as .required and approved. by the City Fire Department. 12. That if required by the Fire Department, pedestrian and vehicular access gates shall be equipped with a "knox box" device to the satisfaction of the City Fire Department. 13. That fire sprinklers shall be installed as required by the City Fire Department. 14. That trash storage areas shall be provided and maintained in a location acceptable to the Street Maintenance and Sanitation Division and in accordance with approved plans on file with said Division. 15. That the proposal shall comply with all signing requirements of the ML "Industrial, Limited" Zone, unless a variance allowing sign waivers is approved by the City Council, Planning Commission or Zoning Administrator. 0109g 3 ZA88-54 • • Page 4 ~ ,, Variance No. 3838 16. That all air conditioning facilities and other roof- and ground-mounted equipment shall be properly shielded from view. 17. That prior to final parcel map approval, the original documents of the covenants, conditions, and restrictions, and a letter addressed to the developer's title company authorizing recordation thereof, shall be submitted to the City Attorney's Office and approved by the City Attorney's Office, Public Utilities Department and Engineering Division. Said documents, as approved, shall then be filed and recorded in the Office of the Orange County Recorder. 18. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. 19. That in connection with driveway curb cut installation along La Palma Avenue, a bus turn-out .shall be installed westerly of the intersection of La Palma Avenue and Kellogg Drive, to the satisfaction to the City Traffic Engineer. 20. That prior to final .parcel map approval or within a period of one year from the date of this decision, whichever occurs first, Condition Nos. 2, 7, 17 and 18, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 21. That prior to issuance of a building permit, Condition Nos. 1, 8, 9 and 19, above-mentioned, shall be complied with. 22, That prior to final building and zoning inspections, Condition Nos. 3, 5, 6, 10, 13, 14 and 16, above-mentioned, shall be complied with. 23. That none of the conditions herein are intended to be inconsistent with conditions previously established in connection with the .granting of Conditional Use Permit Nos. 2922 or 3010. If any inconsistencies arise, final determination shall be made by the appropriate departments as .identified in said conditions. 24.
