ZA 91-1 VARIANCE NO. 4104 CEQA STATUS: Negative Declaration DATE OF PUBLIC HEARING: January 10, 1991 OWNER: Catellus Development Corporation 3230 East Imperial Highway, Brea, CA 92621 AGENT: Rick Del Carlo 3230 East Imperial Highway, Brea, CA 92621 LOCATION: Subject property consists of approximately 7.0 acres located at the southeast corner of Manassero Street and Landon Drive. OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, and no correspondence in opposition was received.. REQUEST: Petitioner requests waiver of the following under authority of Code 'Section 18.12.060.110 to add 2,725 sq.ft. of industrial space to a previously approved 3-building industrial complex: SECTIONS 18.06.050.0212 - Minimum number of narkincL spaces. 18.06.0.50.031 (351 required; 269 proposed) 18.06.080 and 18.61.066.050 Having been. appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That a letter and. parking analysis, dated November 28, 1990 and titled "Parking Study for Santa Fe Corporate Center 5 at Manassero Street and Landon Drive", was submitted by Rock E. Miller and Associates and .approved by the City Traffic Engineering Section for the following specific overall combination of uses: USE FLOOR AREA General industrial: 117,775 sq.ft. Office: 21.500 sq.ft. Total: 139,275 sq.ft. 2. That the variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining -land uses; and 3. That the granting of the variance under the conditions imposed will not. be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. ZA-4104 - 1 - ZA 90-1 ~, ~ . • • Variance No. 4101 Page 2 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum number of parking spaces to add 2,725 sq.ft. of industrial space to a previously approved 3-building industrial complex on a rectangularly-shaped parcel of land consisting of approximately 7.0 acres located at the southeast corner of Landon Drive and Manassero Street, having approximate frontages of 665 feet on the south side of Landon Drive and 515 feet. on the east side of Manassero Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study. and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approved Variance No. 4101, subject to the following conditions: 1. * That unless proof of exemption is submitted in compliance with City Council Resolution No. 85R-423,. prior to issuance of a building permit, the appropriate major thoroughfare and bridge fee shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfare-and Bridge Fee Program for the Foothill/Eastern Transportation Corridor, as established by City Council resolution. 2. * That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be .paid to the City of Anaheim in an amount as established by City Council resolution, if required by the City Engineer when considering the fees paid for Parcel Map No. 86-431. 3. * That prior to issuance of a building permit, the appropriate drainage assessment fee shall be paid to the City of Anaheim in an amount as established by City Council Resolution. 4. * That trash storage areas shall be provided and maintained in a location acceptable to the Street Maintenance and Sanitation Division and in accordance with approved plans on file with said division. Such information shall be specifically shown on the plans submitted for building permits. 5. That an unsubordinated reciprocal access and parking agreement for the entire subject .property, in a form satisfactory to the City Attorney, shall be recorded with the Office of the Orange County Recorder. A copy of the recorded agreement shall then be submitted to the Zoning Division. 6. That all driveways along Landon Drive and Manassero Street shall be .constructed with fifteen (15) foot radius curb returns as required by the City Engineer in conformance with Engineering Standards. 7. * That plans shall be submitted to the City Traffic Engineer for his review and approval showing conformance with the latest revision of Engineering Standard Plan Nos. 436, 602 and 605 pertaining to parking standards. Subject property shall thereupon be developed and maintained in conformance with said plans. ZA-4104 - 2 - ZA 90-1 ~„ Variance No. 4101 Page 3 8. .That no required parking areas shall be fenced to accommodate outdoor .material storage. 9. That a plan showing loading space as required per Code Section No. 18.06.060 for trucks SHALL be submitted to and approved by the City Traffic Engineer. 10.* That grading and drainage of subject property shall conform to Chapter 17.04 "Grading, Excavations, Fills and Water Courses" of the Anaheim Municipal Code. il.* That subject property shall be served by underground utilities. 12. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file .with the Planning Department marked Exhibit Nos. 1 through 9. 13. That prior to issuance of a building permit or within a period of one {1) year ,from the date of this decision whichever occurs first, Condition Nos. 1, 2, 3, 4, 5, 7 and 9,-above-mentioned, shall be complied with. Extensions for further time to complete said .conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 14. That prior to final building and zoning inspections, Condition. Nos. 4, 6, 10, 11 and 12, above-mentioned, shall be complied with. 15.* That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable .City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Conditions marked with an asterisk (*) are required by established laws, codes, regulations and agreements and are, therefore, not subject to negotiation.
