ZA 91-5, NUNC PRO TUNC, PERTAINING TO VARIANCE NO. 4106 MEETING DATE: February 7, 1991 OWNER:, HILL WILLIAMS DEVELOPMENT CORP. 175 Riverview Drive, Suite 200, Anaheim CA 92808 AGENT: FRANK GONZALES & ASSOCIATES 1336 Chapman. Avenue, Orange CA 92666 LOCATION:'-Subject property consists of approximately 5.03 acres located on the east side of Henning Way approximately 1,100 feet south of the centerline of Arboretum Road (Tract No. 11600). WHEREAS, on January 24, 199.1, a public hearing was held to consider approval of Variance No. 4106 to permit waiver of maximum structural height to construct nine (9) single-family residences; WHEREAS, during the .public hearing and as a condition ofapproval of subject variance, a new condition of approval (to-be new Condition No. 9) was added, and old Condition Nos. 9 through ll were renumbered Condition Nos. 10 through-12, but through inadvertence and error said addition and modifications were not .included in Decision No. ZA 91-5; .THEREFORE, it is hereby determined that a new Condition No. 9 be added to Decision No. 91-5, to read as follows:. "9. That prior. to the sale of any lot in Tract No. 11.600 or prior to issuance of an occupancy permit for any house in Tract No. 11600 or within a period of sixty (60) days from the date of this decision, whichever occurs first, the property owner shall record a covenant pertaining to the design of any fencing or walls constructed along the west property dine, which fencing or wall parallels and is visible from Henning Way. Said covenant shall specify that any new or future fencing or walls along the west property lines of Lot'Nos. 6,-7 and 8 of .Tract No. 11600, from the south property line of said tract .northerly to the "crash gate" on Lot No. 8, shall be the same in terms of-design, construction material(s) and color(s). Said covenant shall be submitted to the Planning Department and the City Attorney for review and approval:.prior o recordation with the Orange County Recorder. A copy of the recorded .covenant shall then be submitted to the Planning Department." AND FURTHER, be it determined that the old Condition Nos. 9 through 11 of'Decision No_ 91-5 be renumbered Condition Nos. l0 through l2.
