Petitioner requests waiver of the following under authority of Code Section 1$.12:060.'1'10 to retain a fenced storage area: SECTIONS 18.06.050.0212 - Minimum number of narking spaces. 18.06.050.031 (132; required; 96 proposed) 18.06.050.033 18:06.080 and 18.61.066:050 Having been appointed Zoning Administrator ,by the Planning: Director, pursuant to Anaheim. Municipal Code Section 18.12:'040, to decide the above-referenced petition and a public hearing ..having been duly noticed for and ...held on the date set forth :above, I do`hereby finds 1. That City Traffic Engineering concurred with the parking study (dated, December 20 1990 and; prepared by TSE Traffic_Safety Engineers)_for the specific combination of uses on subject property:' 20,998.:sq.ft. of warehousing and manufacturing uses,:. 19,146 sq.ft. of office-related uses, and 6,525 sq.ft. of outdoor. storage area; 2. That the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect .any adjoining land uses; and 3. That the granting of the parking variance under the conditions-.imposed, if any, will:not;be detrimental to the peace, health, safety or general welfare of the citizens of the City: of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY-:ACT-FINDING: That the Zoning Administrator has reviewed the proposal for waiver of minimum number of parking spaces to retain a fenced storage area on arectangularly.-shaped parcel of land consisting of approximately 2:0 acres_located at the northeast corner of La Palma Avenue and Fee` Ana'Street, having approximate frontages of 251°feet'on the north side of La Palma' Avenue and 345 feet on-the east side of Fee '.Ana Street, and further described as 4305 East La'Palma.Avenue; and that the Planning Director: or his authorized representative has determined that-the proposed project falls within the definition of Categorical Exemptions, Classll, as defined in the State EIR Guidelines and is, therefore, .categorically exempt from the requirement. to prepare an EIR. ZA-4128 -1- ZA 91-24 Page 2 Variance No. 4128 Based on the evidence and testimony presented to me, I do hereby determine to APPROVE Variance No. 4128, subject to the following conditions: 1. That the gated storage area/drive aisle shall remain open during business hours. 2.* That all lockable pedestrian and/or vehicular access gates shall be equipped. with "knox box" devices as required and approved by the Fire Department. 3. a. That-no combustibles shall be stored closer than three (3) feet to .the east .property line;, b. That the fence enclosing the outdoor storage area and facing La Palma Avenue shall be raised and maintained at a height equal to (at least ten [10] feet) or higher than the material stored inside the storage area and that said fence 'shall be_entirely interwoven with redwood or cedar slats. 4. That subject property shall be developed. substantially in accordance with plans and specifications submitted to-the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. l and 2. 5. That prior to issuance bf a building permit or within a period of ninety (90) days,,from the date of this decision, whichever occurs first, Condition Nos. 1, 2, 3 and 4, above-mentioned, shall be complied with. Extensions for further time;to_complete said conditions may be granted in accordance with Section 18.03..090 of the Anaheim Municipal Code. 6.* That approval of this application.constitutes approval of the proposed request only to the extent that it .complies. with the;: Anaheim Municipal Zoning,Code and any other applicable City, State and Federal regulations. ,Approval does not include any action or findings as to compliance or approval. of the request regarding-,any other applicable ordinance, regulation or requirement. Conditions -marked with an asterisk (*) are required by established ,laws, codes, regulations and agreements and are, therefore, not subject to negotiation.
