ZA 91-32 PETITION: VARIANCE NO. 4133 CEQA STATUS: Negative Declaration DATES OF PUBLIC HEARING: July 11, 1991; continued to August 8, 1991 OPPOSITION: No one indicated their presence in opposition to the proposal, and no correspondence in opposition was received. OWNER: CATELLUS DEVELOPMENT 1065 North Pacific Center, Anaheim CA 92806 Attention: Rick Del Carlo LOCATION: Subject property consists of approximately 6.6 acres located at the northeast corner of La Palma Avenue and Manassero Street. REQUEST: Petitioner request .waivers of the following under authority of Code Section 18.12.060.110 to permit a 153,680 sq.ft. research and development building: A. SECTIONS 18.06.050.0212 - Minimum number of Aarkina spaces. 18.06.050.031 (589 required; 461 proposed) 18.06.080 and 18.61.066.050 B. SECTIONS 18.06.060.010 - Required number.of loading spaces. 18.12.060.110 (6 required; 4 proposed) and 18.61.066.070 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the City Traffic Engineering Division conditionally approved the parking study submitted by the petitioner and prepared by Rock E. Miller and Associates (dated June 12, 1991); a letter prepared by Rock E. Miller and Associates dated May 24, 1991; and a letter submitted by the petitioner dated July 26, 1991; 2. That the parking variance will not cause. an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and 3. That the granting of the parking variance under the conditions imposed, if :any, will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. ZA-4133 -1- ZA 91-32 Page 2 Variance No. 4133 • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waivers of minimum number of parking spaces and required number of loading spaces to permit 153,680 sq.ft. industrial building on a rectangularly-shaped parcel of land consisting of approximately 6.6 acres located at the northeast corner of La Palma Avenue and Manassero Street, having approximate frontages of 598 feet on the north side of La Palma Avenue and 478 feet on the east side of Manassero Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to APPROVE Variance No. 4133, subject to the following conditions: 1. * That unless proof of exemption is submitted incompliance with City Council Resolution No. 89R-440 prior to issuance of a building permit, the appropriate major thoroughfare and bridge fee shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfare and Bridge Fee Program for the Foothill/Eastern Transportation Corridor, as established by City Council resolution. 2. That the developer of the subject property shall confer with the. property owners of the property on the south side of La Palma Avenue across from Manassero Street, to combine the two (2) existing driveways into a single driveway. The centerline of the new driveway shall be aligned with the centerline of Manaserro Street to improve traffic operations and reduce conflict at this location. The plans for this new driveway shall be submitted to the City Traffic and Transportation Manager for review and approval, and the driveway shall be constructed prior to the full operation of the traffic signal. 3. * That plans shall be submitted to the City Traffic Engineer for his review and approval showing conformance with the latest revision of Engineering Standard Plan Nos. 436 and 602 pertaining to :parking standards and driveway locations. Subject property shall thereupon be developed and maintained in conformance with said plans. 4. That all driveways shall be constructed with fifteen (15) foot radius curb returns as required by the City Engineer in conformance with Engineering Standards. 5. That the developer shall comply with City of Anaheim Ordinance No. 5209 and Resolution No. 91R-89 pertaining to Transportation Demand Management (TDM). ZA-4133 -2- ZA 91-32 • • Page 3 Variance No. 4133 6. * That subject property authorized by this resolution shall be served by .underground utilities. 7. That the legal property owner/developer shall provided and install underground conduits, substructures, and related material as required by the City of Anaheim Rates, Rules, and Regulations for Underground Line Extensions. 8. That the legal property owner/developer shall pay a fee in accordance with the City of Anaheim Rates, Rules, and Regulations for the instaiiation of cables, switches, and related material to be installed~in developer-provided conduit and substructures. 9. * That trash storage areas shall be provided and maintained in a location acceptable to the Street Maintenance and Sanitation Division and in :accordance with approved plans on file with said division. Such information shall be specifically shown on the plans submitted for building permits. 10'. That prior to issuance of a building permit, a solid waste management .plan with recycling capabilities shall be approved by the Street Maintenance and Sanitation Division. Upon occupancy of the project, said plan shall commence and shall remain in full effect as required by said Division. 11. * That prior to commencement of structural framing, on-site fire hydrants shall be installed and charged as required and approved by the Fire Department. An all-weather road shall be provided to the hydrants at all times, as required by the Fire Department. 12. * That fire sprinklers shall be installed as required by the Fire Department. 13. That prior to issuance of a building permit, a Lot Line Adjustment Plat shall be submitted to the Subdivision Section and approved by the City Engineer and then recorded in the Office of the Orange County Recorder. -The lot lines shall be ;adjusted such that the lot lines agree with the approved site plan. 14. That prior to issuance of a building permit and in lieu of payment of traffic signal assessment fees, the owner/developer shall construct traffic signals at the intersections of Kellogg Drive and La Palma Avenue and at Manassero Street and La Palma Avenue; and shall construct a median island in La Palma Avenue between Kellogg Drive and Manassero Street as required and approved by the City Traffic and Transportation Manager; and that security in the form of a bond, certificate of deposit, letter of credit or cash, in an amount and form satisfactory to the City of Anaheim ZA-4133 -3- ZA 91-32 • Page 4 Variance No. 4133 • shall be posted with the City to guarantee the satisfactory completion of said improvements. Said security shall be posted with the City to guarantee installation of the above-required improvements: the installation of the traffic signal at the intersection of Kellogg Drive and La Palma Avenue, the installation of traffic, signal at the intersection of Manasserro Street and La Palma Avenue, and the construction of the median in La Palma Avenue when a curb cut is required and .approved on La Palma Avenue between Kellogg Drive and Manassero Street. 15. That. prior to issuance of a building permit, the appropriate drainage assessment fee shall be paid to the City of Anaheim in an amount established by City Council Resolution. 16. That prior to occupancy, sidewalks shall be constructed along La Palma Avenue as required by the City Engineer and in accordance with standard plans and specifications on file with the Office of the City Engineer; and that security in the form of a bond, certificate of deposit, letter of credit or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of said improvement when a curb cut is required and approved on La Palma Avenue between Kellogg Drive and Manassero Street. 17. * That the proposal shall comply with all signing requirements of the ML Zone, unless a variance allowing sign waivers is approved by the City Council, Planning Commission or Zoning Administrator. 18. That any proposed freestanding sign on subject property shall be a monument-type not exceeding eight (8) feet in height and shall be subject to the review and approval of the City Traffic and Transportation Manager to determine adequate lines-of-sight. 19. That a landscape and irrigation plan for subject property shall be submitted to the Zoning Division for review and approval. Any decision made by the Zoning Division regarding said plan may be appealed to the Planning Commission and/or City Council. 20. * That the on-site landscaping and irrigation system shall be maintained in compliance with City standards. 21. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the. Planning Department marked of Exhibit Nos. 1, 2, 3 and 4. ZA-4133 -4- ZA 91-32 Paqe 5 Variance No. 4133 22. That prior to issuance of a building pernnit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 1, 3, 8, 9, 10, 13, 14, 15 and 19, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 23. That prior to final building and zoning inspections, Condition Nos. 2, 4, 5, 6, 7, 12, and 21, above-mentioned, shall be complied with. 24. * That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Conditions marked with an asterisk (*) are required by established laws, codes, regulations and agreements and are, therefore, not subject to negotiation.
