REQUEST: Petitioner requests waiver of the following to permit a 30,000 sq.ft. industrial building, a 18,500 sq.ft. industrial building and a 24,000 sq.ft. industrial buildings SECTIONS 18.06.050.0212 - Minimum number of parking spaces. 18.06.050.031 (209 required; 183 proposed) 18.06.080. and 18.61.066.050 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing. having been duly noticed .for and held on the date set forth above, I do hereby find: 1. That: the Parking Study prepared by Rock E. Miller and Associates, and dated June`20, 1991, was reviewed and approved by City Traffic Engineering staff; 2. That the approved Parking Study establishes the following overall parking ratio for subject multi-tenant industrial complex with accessory business offices: a minimum of 2.88 spaces/1;000 sq.ft. of gross floor area, assuming that at least 64.2 oP the total project floor area is general industrial and/or warehousing uses and no more than 35.8 of the total floor area consists of "research and development" uses or accessory business offices for the primary industrial uses; 3. That the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and 4. That the. granting of the parking variance under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. ZA-4142 -1- ZA 91-39 • • Page 2 Variance No. 4142 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of minimum number of parking space to permit a 30,000 sq.ft. industrial building, a 18,500 sq.ft. industrial building and a 24,000 sq.ft. industrial building on a rectangularly-shaped parcel of land consisting of approximately 4 acres located at the southeast corner of Hunter Avenue and Manassero Street, and having approximate frontages of 201 feet on the south side of Hunter Avenue and 587 feet on the east side of Manassero Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of .the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to APPROVE Variance No. 4142, subject to the following conditions: 1. * That prior to issuance of a building permit, a Lot Line Adjustment Plat to adjust the property line of Parcel Nos. 1 and 6 (Parcel Map No. 229, pages 37 and 36) such that any new building lies completely within one (1) parcel shall be submitted to the Subdivision Section for. review and approval. by the City Engineer. It shall then be recorded in the Office of the Orange County Recorder. 2. * That unless proof of exemption is submitted in compliance with City .Council Resolution No. 89R-440 prior to issuance of a building permit, the appropriate major thoroughfare and bridge fee shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfare and Bridge Fee Program for the Foothill/Eastern Transportation Corridor, as established. by City Council resolution. 3. * That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as established by City Council resolution and as required by the City Traffic and Transportation Manager. 4. * That gates shall not be installed across any driveway or private street in a manner which may adversely affect vehicular traffic in the adjacent public streets. Installation of any gates shall conform to Engineering Standard Plan No. 609 and shall be subject to the review and approval of the City Traffic and Transportation Manager prior to issuance of a building permit. 5. * That plans shall be submitted to the City Traffic and Transportation Manager for his review and approval showing conformance with .the latest revisions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway locations. Subject property shall thereupon be developed and maintained in conformance with said plans. ZA-4142 -2- ZA 91-39 • • Page 3 Variance No. 4142 ' 6. That all driveways shall be constructed with fifteen (15) foot radius curb returns. as required by the City Engineer in conformance with Engineering Standards. 7. That a plan be submitted showing that loading space(s) for trucks conform with Code Section 18.06.060. 8. That the developer shall comply-with Chapter 14.60."Transportation Demand" of the Anaheim Municipal Code relating to the Transportation Demand Management (TDM). 9. * That prior to commencement of structural framing, fire hydrants shall be installed and charged as required and approved by the Fire Department. 10. (a) That the overall parking ratio for the entire 4-acre site and the proposed approximately 73,000 sq.ft. of building floor areas (plus or .minus) shall be maintained at a minimum of two and eighty eight hundredths parking spaces per one thousand sq.ft. of gross floor area (2.88 parking spaces/1,000 sq.ft. gross floor area); and (b) That the mix of industrial uses to "research and development" and/or accessory office uses in subject multi-tenant industrial complex shall be maintained as follows: (1) At least sixty four and two tenths percent (64.2) of the total project floor area shall be general industrial and/or warehousing uses (primary uses), and (2) No more than thirty five and eight tenths percent (35.8) of the total floor area shall be research and development uses and/or accessory business offices for the primary industrial uses. (3) That the "research and development" and accessory office portions of each building may exceed thirty five and eight tenths percent (35.8) of that specific building's floor area but the combined "research and development" and offices on .the entire subject property shall not exceed thirty five and eight tenths percent (35.8) of the total site's floor areas. (c) All plans (including. tenant improvements), submitted for building permits and which propose new "research and development" and/or office space, shall include the current plus proposed status of the minimum over-all site parking ratio (2.88 spaces/1,000 sq.ft.), and the existing and proposed percentages of general industrial and "research and development"/office floor space. The purpose is to verify. that the required ratios and percentages are maintained at all stages of development. ZA-4142 -3- ZA 91-39 • • Page 4 Variance No. 4142 11.* That fire sprinklers shall be installed as required by the Fire Department. 12.* That trash storage areas shall be provided and maintained in a location acceptable to the Department of Maintenance and in accordance with approved plans on file with said Department. Such information shall be specifically shown on the plans submitted for building permits. 13. That a Plan Sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 14. That .subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1 through 3. 15. That prior. to issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 1, 2, 3, 4, 5, 7, 10, 12 and 13, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 16. That. prior to final building and zoning inspections, Condition Nos. 6, 8, 11 and 14, above-mentioned, shall be complied with.. 17.* That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Conditions marked with an asterisk (*) are required by established laws, codes, regulations and agreements and are, therefore, not subject to negotiation.
