REQUEST: Petitioner requests waiver of the following under the authority of Code Sections 18.06.080 and 18.12.060.110 to establish a 4-lot commercial subdivision: SECTIONS 18.06.050.022 - Minimum number of parkina spaces. 18.06.050.0222 (98 required for Lot No. 1 [141 for 18.06.050.0225 the entire site]; 18.06.050.0241 53 existing on Lot No. 1 [173 on the and 18.46.066.050 entire site)) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the City Traffic Engineering staff has concurred with the Parking Variance Study dated September 10, 1991 and prepared by Greer & Co. for this specific proposal. That the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and 3. That the granting of the parking variance under the conditions imposed, if any, will not be detrimental to the peace, health, safety or general welfare of the citizens of the .City of Anaheim because adequate parking will be available elsewhere on subject property. because a recorded covenant will be provided to provide reciprocal parking and access across all four lots (Nos. 1, 2, 3 and 4). CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has. reviewed the proposal for waiver of minimum number of parking spaces to establish a 4-lot, commercial subdivision on a rectangularly-shaped parcel consisting of approximately 5.11 acres located at the southeast corner of Lincoln Avenue and Beach Boulevard, having approximate frontages of 260 feet on the south-side of Lincoln Avenue and 590 feet on the east side of Beach Boulevard, and further described as 2970 West Lincoln Avenue; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.4151, subject to the following condition: 1. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. This decision is made, signed, and entered into the file this twenty-first day of November, 1991. Annika M.
