REQUEST: Petitioner requests waiver of the foflowing to establish awarehouse/distribution center with accessory office space under authority of Code Section 18.12.060.110: SECTIONS 18.06.050.0212 - 18.06.050.031 18.06.080 and 18.61.066.050 Minimum number of parking spaces. 836 required; 316 existing) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That a parking demand study, submitted by the petitioner, was reviewed and approved by the City Traffic and Transportation Manager for this specific building and the uses it will contain; and when the vacant portion of subject property is developed, the parking needs for the entire subject property will be reanalyzed to verify that adequate parking is provided for both the existing and any new uses; 2. That the granting of the parking waiver will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and 3. That the granting of the variance under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of the minimum number of parking spaces to establish awarehouse/distribution center with accessory offices on arectangularly-shaped parcel of land consisting of approximately 20.4 acres za-V4244:wp - 1 of 3 - ZA 94-05 • • located between Santa Ana Street and South Street, having frontages of approximately 561 feet on the south side of Santa Ana Street and 561 feet on the north side of South Street, having a maximum depth of approximately 1,596 feet, being located approximately 590 feet west of the centerline of East Street and further described as 901 East South Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4244, subject to the following conditions: 1. That a minimum of three hundred sbcteen (316) parking spaces shall be provided for employees and customers. 2. That the developer shall comply with Chapter 14.60 '?ransportation Demand" of the Anaheim Municipal Code relating to Transportation Demand Management (TDM). 3. That, in connection wfth the approved parking waiver, use of subject building shall be limited to a maximum of thirty thousand five hundred fifty one (30,551) square feet of offices and a minimum of three hundred seventeen thousand two hundred twenty seven (317,227) square feet of warehouse. If and when the vacant portion of subject property is developed, the parking needs for the entire subject property will be reanalyzed to verify that adequate parking is provided for both the existing and any new uses. 4. That at least forty seven (47) truck/trailer parking spaces shall be provided for loading and unloading. 5. That the developer shall pay a traffic and transportation improvement fee to the City of Anaheim, Traffic Engineering Division, in an amount established by the City Council Resolution. This fee will be used to fund traffic and transportation improvements in the area impacted by this project. Said fee shaA be subject to adjustment by the City Council 6. That plans shall be submitted to the City Traffic and Transportation Manager for his review and approval showing confiormance with the current versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway location. Subject property shall thereupon be developed and maintained in conformance with said plans. 7. That all driveways on South Street shall be reconstructed to accommodate ten (10) foot radius curb returns in conformance with Engineering Department Standard No. 137. 8. That no parking, driveway or required landscaped areas shall be fenced-in to accommodate storage of materials. 9. That an on-site trash truck turn-around area be provided in accordance with Engineering Standard Detail No. 610, as required by the Department of Maintenance. 10. That a plan shall be submitted showing that the loading spaces for trucks comply with Code Section 18.06.060. 11. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibft Nos. 1 through 4. za-V4244.wp - 2 of 3 - ZA 94-05 • 12. That trash storage areas shall be provided and maintained in a location acceptable to the Department of Maintenance and in accordance with approved plans on file with/ said Department. Such information shail be specifically shown on the plans submitted for building permits. 13. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 14. That prior to issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 5, 6, 9, 10, 12 and 13, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 15. That priorto final building and zoning inspections, Condition Nos. i, 4, 7 and 11,above-mentioned, shall be complied with. 16. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
