Rulloda 2927 Haddonfield Loop Fullerton, CA 92631 LOCATION: 843 South State College Boulevard CEQA STATUS: Negative Declaration HEARING DATE: May12, 1994 _ OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received. REQUEST: Petitioner requests waiver of the following under authority of Code Section 18.12.060.110 to establish a floral design school and retail florist: Sections 18.44.066.050 Minimum number of parkins spaces. 18.06.050.0212 73 s aces required; 23 spaces proposed) 18.06.050.022 and 18.06.050.0261 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code _ Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the granting of the parking waiver .wilt not .cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses because the maximum number of students will be sixteen (16) per class and the maximum number of employees will be nine (9) during peak holidays; and 2. That the granting of the parking variance under the conditions imposed will not be detrimental to the 'peace, health, safety or general welfare of the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of the minimum number of parking spaces on an irregularly-shaped parcel of land consisting of approximately 0.41 acre, having a frontage of approximately 100 feet on the west side of State College Boulevard, having a maximum .depth of approximately 188 feet, being located .approximately 480 feet south of the centerline of South Street and further described as 843 South State College Boulevard; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received. during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4247, subject to the following conditions: 1. That a minimum of twenty three (23) parking spaces shall be provided for students, employees and customers. za-V4247.wp - 1 of 2 - ZA 94-10 ~' ~~ ~ • 2. That on the following holidays no floral design classes shall be conducted: Valentine's Day, Mother's Day, Easter, Thanksgiving and Christmas. 3. That, as required by the City Traffic and Transportation Manager, the parking lot shall be restriped in conformance with the current versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway locations. Subject property shall thereupon be maintained in conformance with said standards. 4. That trash storage areas shall be provided and maintained in a location acceptable to the Department of Maintenance in accordance with approved plans on file with said Department. 5. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 6. That an on-site trash truck turn-around area shall be provided and maintained to the satisfaction of the Department of Maintenance. 7. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1 through 3. 8. That prior to commencement of the activity authorized by this decisions or within a period of one (1) year from the date of this decision, whichever occurs first, Conditions Nos. 1, 3, 4, 5, 6 and 7 above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 9. That the maximum number of students shall be sixteen (16) per class and the typical number of .employees will be two (2) with the maximum being nine (9) employees during the peak holidays (Valentine's Day, Mother's Day, Easter, Thanksgiving and. Christmas). 10. That approval of this application constitutes approval of the proposed request only to the extent that ft complies wfth the Anaheim Municipal Zoning Code and any other applicable .City, State and Federal regulations.
