Resolution-ZA 1994-20~ ~ DECISION NO. ZA 94-20 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE NO. 4257 OWNERS: Ellis E. and Marlene J. Marcum 237 North Milford Road Orange, CA 92667 LOCATION: 415 South Anaheim Boulevard CEQA STATUS: Negative Declaration HEARING DATE: August 4, 1994 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received. REQUEST: Petitioner requests waiver of the following to retain a 1,000 sq. ft. storage area on the second floor of an existing industrial building: Sections 18.06.050.031 18.12.060.110 ~~ and 18.61.066.050. - Minimum number of parking s ces. 11 required; 6 existing) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the. dateset forth above, I do hereby find: 1. That the granting of the parking variance for the existing business, a cabinet shop, will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; 2. That the granting of the variance under the conditions imposed will not be detrimental to the peace, health,, safety or general we{fare of the. citizens of the City of Anaheim; and 3. That the original parking lot was reduced in area as a result of the widening of Anaheim Boulevard. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for a parking variance on arectangularly-shaped parcel of land consisting of approximately 5,950 sq.ft., having a frontage of approximately 50 feet west of Anaheim Boulevard, having a maximum depth of approximately 119 feet, being located. approximately 160 feet south of the centerline of Elm Street, and further described as 415 South Anaheim Boulevard; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on-the basis of the initial study and any comments received that there is no substantial evidence that the project will have a signfficant effect on the environment. Based on the evidence and testimony presented to me, I do hereby approve Variance No. 4257, subject to the following conditions: za-v4257.wp - 1 of 2 - ZA 94-20 1. That the subject parking variance is granted specifically for a second story, one thousand (1,000) sq.ft. storage area in the existing cabinet shop which has a maximum of four (4) employees; and that a minimum of six (6) parking spaces shall be maintained as shown on the approved site plan. Approval of a separate parking variance will be required in the event that the subject building is utilized for any business other than a cabinet shop unless compliance with Code parking requirements can be demonstrated. 2. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 3. That an on-site trash truck turn-around area shall be provided and maintained to the satisfaction of the Department of Maintenance. Said turn-around area shall be specifically shown on plans submitted for building permits. 4. That subject property shall be developed substantially in accordance with plans and spec cations submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2. 5. That the appropriate permits shall be obtained from the Building Division. 6. That prior to issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 2, 3, 4 and 5, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 7. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning .Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Santalahti, Zoning Administrator, considered your request. for asix-month allowance for temporary flags and banners to be placed at Chaparral Apartments at 1219 N. State College Boulevard. Ms. Santalahti approved the special circumstances waiver, which will expire 6 months .from the date a valid flag and banner permit is issued; on the basis of the substantial fire damage to the property in December, 1993 and the subsequent reconstruction.
