Anderson John Anderson and/or Phillip Schwartze 15028 Imperial Highway, La Mirada, CA 90638 LOCATION: 730 North EuGid Street CE~A STATUS: Negative Declaration HEARING DATE: August 18, 1994 OPPOSITION: Two people spoke at the public hearing with concerns regarding traffic congestion and whether there were plans for raised medians restricting left turns into businesses along Euclid Street. REQUEST: Petitioner requests approval ofia conditional use permit under authority of Code Sections 18.12.050.040 and 18.44.050.270 to permit a ; pfirate educational facility (christian university) with waiver of the following: Sections 18.06 050 0212 - Minimum number of rking s es. 18.06.050.022 (2QQ required per parking study; _18.06.050.0261 1~4 existing) 18.06.080 18.12.060.110 and 18.44.066.OSn Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced petition, pursuant to Anaheim Municipal Code Section 18.12.020, and a public hearing having been duly noticed for and held on the date set forth above, 1 do hereby find, pursuant to the Sections 18.02.030.030 through 18.02.030.035 of the Anaheim Municipal Code: 1. That a parking study, prepared by Traffic Safety Engineers and .dated July 5, 1994, substantiates the requested parking waiver for this specific combination of uses and was approved by the City Traffic and Transportation Manager as to adequacy based upon the total number of students being limited to 175 and a minimum of 194 parking spaces being. provided; 2. That the applicant testffied at the public hearing that the students are primarily adults from 30 to 35 fNe years old, and that classroom instruction will generally occur during off peak hours and will typically take place as follows: Monday: Tuesday through Friday: Library: All day 4:00 pm to 11 pm Most of the time ZA-C3709.wp - 1 of 3- ZA 94-21 • ~ 3. That the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses because the parking lot for subject building is isolated and accessible sdely to users in said building and students would be unlikely to use any other parking lots; 4. That the granting of the parking variance under the conditions Imposed, will not be detrimental to the, peace, health, safety or general welfare of the ckizens of the City of Anaheim; 5. That the proposed use is properly one for which a conditional use permit is authorized by the Zoning Code; 6. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located; 7. That the size and shape of the site for the proposed use is adequate to allow the full development of the proposed use. in a manner not deMmental to the particular area nor to the peace, health, safety and general welfare; 8. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 9. That the granting of this Conditional Use Permit, under the conditions imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL OUAUTY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal to establish a private educational facility on arectangularly-shaped parcel of land consisting of approximately 1.8 acres having an approximate frontage of 132 feet on the east side of Euclid Street, having an approximate depth of 607 feet, being .located approximately 860 feet north of the centerline of Crescent Avenue and further described as 730 North Euclid Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with anycomments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect. on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Conditional Use Permit No. 3709, subject to the following conditions: i. That the total number of students shall be limned to one hundred seventy five (175). 2. That subject parking variance is granted specifically for the proposal which consists of a twenty two thousand (22,000) sq.ft. private nonprofit religious educational facility (university) on the first and second floors of an existing 3-story office building; and that a minimum of one hundred ninety four (194) parking spaces shall be provided at all times. Approval of a separate parking variance will be required in the event that subject building is utilized .for any business. other than subject university and offices unless compliance with Code parking requirements can be demonstrated. 3. That plans shall be submitted to the City Traffic and Transportation Manager for his review -and approval showing conformance with. the most current versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway location. Subject property .shall thereupon be developed and maintained in conformance with said plans. 4. That the driveway on Euclid Street shall be reconstructed to accommodate ten (10) foot radius curb returns, as required by City Traffic and Transportation Manager. ZA-C3709.wp - 2 of 3- ZA 94-2t 5. That trash .storage areas shall be provk)ed and maintained in a location acceptable to the Department of Maintenance and in accordance wfth approved plans on file with saki Department. Such information shall be specifically shown on the plans submitted for building permits. 6. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 7. That an on-site trash truck turn-around area shall be provided and maintained to the satisfaction of the Department of Maintenance. Said tum-around area shall be specifically shown on plans submitted for building permits. 8. That any proposed freestanding sign on subject property shall be a monument-type not exceeding a maximum eight (8) feet In height and forty (40) square feet in area and shall be subject to the prior review and approval of the City Traffic and Transportation Manager to verify adequate lines-of-sight. 9. That subject property shall be developed substantially in accordance with plans and spec~ications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 4. 10. .That prior to commencement of the activity herein approved, or prior to issuance of a building permit, or within a period of one, (1) year ftom the date of this decision, whichever occurs first, Condition Nos. 3, 5, 6 and 7, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 11. That prior to commencement of the activity herein approved or prior to final building and zoning inspections, whichever occurs first, Condition Nos. 4 and 9, above-mentioned, shall be complied with. 12. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
