(3-foot high fence permitted in front 25-foot , structural setback along Collector Streets and no fences permitted in front 10-foot landscaped setback along Collector Streets; 7-foot. 2-inch high block wall f barbed wire fence proposed 5 feet from Santa Ana Street) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: That on March 28, 1988 the Planning Commission approved Conditional Use Permit No. 2992, in part, permitting a contractor's storage yard with waivers of minimum landscaped setback along Santa Ana Street and required screening adjacent to residential zoning, and that approval of said use permit allows a 6-foot high fence adjacent to Santa Ana Street; and that no subsequent action was taken by the City Council; 2. That subject request (to increase the height of a 6-foot block wall previously approved under Conditional. Use Permit No. 2992) is hereby granted in accordance with Subsection 18.12.080.Oi5 of the Anaheim Municipal Code which permits waiver of maximum fence heights in connection with administrative adjustments; 3. That no written opposition was received during the required 10-day notification period which ended on July 3, 1995; CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 1, as defined in the State of California Environmental Quality Act Guidelines and is, therefore, categorically exempt from the requirement to prepare an Environmental Impact Report. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially In accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Santalahti, Zoning Administrator, considered your request for Special Circumstances Waiver No. 95-04 to permit issuance of a Special Event Permit for a pancake breakfast, law enforcement expo and "rod run" on Saturday, September 23, 1995, on property located at 1551 South Douglass Road. She made the following findings: 1. That a letter requesting this special circumstances waiver and describing -the proposal was submitted on July 17, 1995 by Bill Gero, House Manager, Ronald McDonald House of Orange County (a non-profit charitable organization); 2. That the subject property is zoned ML "Limited Industrial" under Reclassification No. 82-83-16 and is developed with a parking lot in connection with Conditional Use Permit No. 3700; 3. That approval of special circumstances waivers (allowing modification and/or waiver of regulations pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning Administrator Review (of Special Events Permits)" and Section 18.12.085 "Special Event Permit -Review" of the Anaheim Municipal Code; 4. That the requested waiver of the standards established by the Section 18.02.055 "Special Event Permit -General" consists of the following: 18.02.055.050 -Permitted location. This special will take place on property developed solely with a parking lot in the ML Zone. Code permits such events in any zone if it is in conjunction with a use for which a conditional use permit has been approved authorizing a use which is permitted as a matter of right in any commercial zone. That the petitioner has indicated that various law enforcement agencies will provide security and traffic control to meet the requirements of Condition No. 5 of Resolution No. PC94-07 (pertaining to an agreement between the property owner and the City ensuring coordination of event parking), adopted in conjunction with Conditional Use Permit No. 3700. 6. That approval of this special circumstances waiver serves the public interest and general .welfare. Under authority of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's letter dated July 17, 1995 and the Staff Report dated 3uly 20, 1995, the Zoning Administrator approved Special Circumstances Waiver No. 95-04 for the herein described special event on Saturday, September 23, 1995, subject to compliance with the following conditions: 1. That prior to September 11, 1995 (or not less than fourteen [14] days prior to the event), the petitioner shall obtain a Special Event Permit from the Planning Department. 2. That this outdoor event and the various activities associated with it shall comply with all the. standards and requirements set forth in Section 18.02.055 "Special Event Permit - General" of the Anaheim Municipal bode unless otherwise specifically provided herein, including that the event shall not be conducted before 7 A.M. nor after 10 P.M., in compliance with Subsection 18.02.055.0606; This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within ten (10) days of the date of this letter or unless members of the City Council request review of this .decision within said 10 days.
